In the shocking case of "Caracal", state institutions did not respect the law and the consequences were particularly serious. FACIAS will lodge complaints against all those responsible for violating the law and will seek their accountability.
FACIAS believes that in this case the authorities have shown gross incompetence and ignorance of the law.
FACIAS calls on the Judicial Inspectorate to investigate and take action on the way prosecutors from the Caracal Prosecutor's Office and the Olt Court Prosecutor's Office have acted, as well as on the defective way DIICOT Craiova prosecutors have conducted the investigation into the case of the other missing girl.
They should have known that intervention can take place without a house search warrant whenever it is necessary, in order to save the life or physical integrity of a person, as provided for in Article 27 of the Romanian Constitution.
The right to life is a fundamental right guaranteed by Article 22 of the Romanian Constitution and no one may claim ignorance of the law.
At the same time, FACIAS calls on the President of Romania, Klaus Iohannis, to urgently dismiss the Head of the Special Telecommunications Service (STS) and to carry out an investigation to find out why the representatives of the institution lied to the public about this case.
In a press release issued in February this year, the STS states that the 112 emergency call service has been modernised and has the ability to identify the EXACT LOCATION from where the emergency service is called, and not "AS POSSIBLE" as it conveyed through its spokesperson: "In the absence of data service, the caller's position will still be able to be communicated to the 112 operator during the phone conversation because the application allows the GPS coordinates to be displayed." The announcement was sent to the STS at the time of the launch of the "Call 112" application for mobile phones which allows the transmission of GPS coordinates at the time of call initiation.
By law, STS is obliged to obtain the exact location. However, paradoxically, in this case, the 15-year-old minor could not be located, as 3 different locations were wrongly identified.
The investigation must also look at how the budget allocated in 2018 for the modernisation of the 112 Emergency Call Service, worth €30 million, was invested.
At the same time, FACIAS wishes to raise an alarm to the SCM regarding the particularly serious social danger that prosecutors currently represent at national level, who constantly, in recent times, by the way they understand to exercise their profession, endanger the safety of citizens, namely, national security. The SCM has the obligation to order the necessary checks in order to hold these prosecutors accountable and remove them from the judiciary, as a measure of security and protection of the fundamental rights and freedoms of citizens.
FACIAS will continue to pursue concrete measures and sanctions in this case that will ensure that such national tragedies do not happen again.
