The Foundation for the Defence of Citizens Against State Abuses has requested the Judicial Inspection to conduct a disciplinary investigation of the prosecutor dealing with the investigation into the death of Andrei Marius Drăgan, the 16-year-old teenager who lost his life at the Târgu-Jiu County Emergency Hospital. Although the court definitively imposed the 30th of June, 2026 as the deadline for completing the criminal investigation, it has been exceeded, and the file is being delayed for almost 20 months.
Andrei Marius Drăgan died on the night of 11th to 12th November, 2024, at the Târgu Jiu County Emergency Hospital, after the doctor on duty refused to operate on him, although the teenager urgently needed surgery for appendicitis complicated by peritonitis. Instead of being operated on immediately, the child was put on the list for transfer to Craiova, and the ambulance only arrived after a few hours, during which time his condition worsened irreversibly. As a result of these facts, FACIAS filed a criminal complaint for manslaughter in December 2024, registered with the Prosecutor's Office attached to the Gorj Court of Law.
Since then, the family and FACIAS have repeatedly demanded that the truth be revealed and that those responsible for Andrei's premature death be held accountable. On the 23rd of March 2026, the Târgu-Jiu Court of Law admitted the appeal regarding the excessive length of the criminal trial and determined that the criminal prosecution must be completed by the 30th June, 2026.
From the analysis of the data on file, FACIAS identified unjustified delays in the submission of essential evidence. The request for the completion of the forensic expertise was submitted by the civil party in April 2025 and reiterated in August and October 2025. However, the request was submitted by the prosecutor to the Institute of Forensic Medicine in Craiova only in April 2026, with a delay of one year.
FACIAS emphasizes that the prosecutor has a legal obligation to actively lead and supervise the criminal prosecution, ensuring a pace of work compatible with the gravity of the act. In a case that concerns the right to life and possible medical negligence in a public hospital, every month of delay decreases the chances of establishing the truth and seriously affects citizens' trust in the justice system.
Through the notification sent to the Judicial Inspection, FACIAS requests the verification of the way in which this file was managed by the prosecutor in charge. There are clear indications of lack of diligence in the submission of evidence, passivity in obtaining medical documents and failure to respect the right to resolve the case within a reasonable time. FACIAS requests the Judicial Inspection to establish whether the criminal investigation into the death of Andrei Marius Drăgan was unreasonably delayed and to order legal measures against the responsible persons, if any violations are found.
FACIAS demands justice for Andrei and will not allow this case to become a forgotten file in a drawer.
