The Foundation for the Defence of Citizens Against State Abuses has sued the Romanian Government and is asking the Bucharest Court of Appeal to oblige the Executive to initiate all legal proceedings to recover the damage of over 600 million euros in the Pfizer case from the guilty parties.
The government cannot remain passive when the state is obliged to pay such a large amount. According to the Constitution, the Administrative Code and the Public Finance Law, the Executive has the obligation to responsibly manage public assets, to verify how the damage to the budget was caused and to use legal instruments to recover the damages generated.
Specifically, FACIAS is requesting the court of law to oblige the Government to initiate the necessary procedure to identify the guilty persons, institutions or public authorities involved and to engage all forms of liability provided by law to protect the patrimonial interests of the state and recover the damage. The purpose of this procedure would be to clarify how this money can be recovered from those responsible and not from the pockets of Romanian citizens.
In the application filed with the Bucharest Court of Appeal, FACIAS emphasizes that the damage caused by the Pfizer contract is now certain. The Romanian state was ordered by the Brussels court to pay approximately 600 million euros for doses of anti-COVID-19 vaccine ordered and not taken over. This amount is increased by an interest of approximately 150,000 euros per day, until the obligations established by the Belgian court are paid.
Following the April 2026 ruling of the Brussels court, FACIAS asked the Parliament to initiate a parliamentary scrutiny of the Pfizer case and to notify the Court of Auditors. FACIAS also notified the DNA regarding the actions of the individuals involved in contracting the Pfizer / BioNTech vaccines, requesting an investigation into a possible abuse of office and negligence in office, as well as full recovery of damages from the responsible ones.
FACIAS will continue all legal steps so that the damage caused by the Pfizer contract may be recovered from the guilty parties, and that citizens do not have to pay for the abusive decisions of those who represented the Romanian state in bad faith.
