The Foundation for the Defence of Citizens Against State Abuses has obtained a new victory in court for the rights of young people in Romania. On the 6th of October, 2026, the Bucharest Court of Appeal decided to sanction the Government of Romania for failing to enforce the final court decision of the High Court of Cassation and Justice regarding the adoption of the implementing rules of the Youth Law.
Following FACIAS's actions, the court imposed a fine of 20% of the gross minimum wage per economy for each day of delay on the Government, and the related amounts are considered income for the state budget. At the same time, the court ordered the Executive to pay to FACIAS penalties of 100 lei per day of delay, for a maximum period of three months, calculated from the date of notification of the conclusion.
FACIAS began this endeavour in 2023, when they sued the Government for failing to adopt the regulation to implement the measures provided for by the Youth Law No. 350/2006. The law provides support for young people who want to start a business: non-refundable financing for consultancy, preferential lending programs and free introductory courses in management and business administration.
The absence of said norms blocked young people's access to the support provided by the law. Entire generations have passed the age at which they could benefit from economic facilities, while the Government made non-functional the provisions supposed to help them start a business.
Although the High Court of Cassation and Justice had definitively confirmed, on the 18th of June, 2025, the Executive's obligation to adopt the norms of the Youth Law, the Government chose to ignore the decision of the Supreme Court. The Executive had a maximum of 30 days to execute the decision, but it has not fulfilled its obligation to this day.
Faced with this institutional inertia, which they consider to be a systematic and abusive refusal to implement the Youth Law, FACIAS once again took the Executive to court and requested its sanction.
The decision of the 6th of October, 2026 of the Bucharest Court of Appeal which sanctioned the Executive for failing to comply with the final decision of the High Court, represents an important victory for all young people in Romania, whose rights have been blocked for over 20 years by the lack of action of political decision-makers. The court's solution confirms that no state institution can evade from observing the law and court decisions, and that their violation entails direct financial consequences.
