The Foundation for the Defence of Citizens Against State Abuses (FACIAS) has filed a preliminary complaint against the National Energy Regulatory Authority and requests the urgent adoption of the regulations required to implement the new rights of prosumers.
According to ANRE data, as of the 31st of July, 2026, Romania had 373,249 prosumers, of which 337,607 were individuals. The installations of all prosumers had a total installed capacity of 4,148.86 MW. At the same time, the contribution of prosumers to the grid supply increased from one year to the next. They injected approximately 1.24 TWh into the electricity grids in 2024 and 1.77 TWh in 2025.
FACIAS thus defends the interests of Romanians who have invested in photovoltaic panels and deliver energy to the grid, but whose ability to use the surplus value for other bills is blocked by the delay in ANRE regulations.
By Law no. 160/2026 amending and supplementing Law no. 123/2012 on electricity and natural gas, Parliament modified the existing compensation mechanism in Romania. The new law, adopted on October 15, 2025, entered into force on July 26, 2026.
Specifically, for installations of up to 200 kW per consumption point, Article 3, point 23¹ of Law no. 123/2012 provides for monthly billing of the energy consumed, the energy delivered to the network and the surplus. Individuals with smaller installations, of up to 27 kW per consumption point, also have an additional right, provided for in Article 73¹, paragraph (3¹). They may opt to use the amounts resulting from the compensation to pay for electricity for other places of their own consumption or for natural gas bills, if they have contracts with the same supplier. Thus, the value of the energy produced in surplus can cover expenses that households must bear from other income.
In order to implement these provisions, Article II of Law No. 160/2026 obliges the President of ANRE to amend and complete the methodology establishing the rules for the trading of electricity produced by prosumers within 60 days of the law entering into force. This deadline expired on the 25th of September, 2026.
FACIAS notes that ANRE has extended the public consultation for the adoption of the new rules until the 1st of October, establishing its own calendar that flagrantly violates the legal deadline imposed by Parliament. Even worse, the ANRE draft proposes that the use of amounts between multiple consumption points only begin on the 1st of January, 2027. The authority invokes the need to adapt the IT systems and procedures of suppliers.
People are faced with this delay on the verge of winter, when heating costs increase household bills. According to INS data, in June 2026 electricity was 59.97% more expensive than in June 2025. At the same time, in September 2026, representatives of the Ministry of Energy estimated that electricity tariffs could increase by up to 10% this fall. In the face of new price increases, ANRE is blocking Romanian prosumers' rights that would allow them to use the value of the surplus energy to pay other bills.
FACIAS requests ANRE to urgently adopt regulations regarding the billing, settlement and use of the value of surplus electricity produced by prosumers and delivered to the network for the payment of eligible bills. At the same time, FACIAS requests the authority to ensure respect for the rights of prosumers for the energy delivered after the entry into force of the law, without further abusively delaying the adoption of the norms. If ANRE fails to fulfil its obligation, FACIAS will request the court to oblige the authority to issue the necessary regulations.
