
The Foundation For The Defense Of Citizens Against State Abuses (FACIAS) has filed a lawsuit against the Ministry of Finances, which has refused to publicly disclose the measures it has taken in the case of the huge damages paid by the Romanian state as a result of a lawsuit lost by the National Road Infrastructure Administration Company (CNAIR).
Official data obtained by FACIAS from CNAIR indicates that between 2015 and 2024, approximately €533 million in compensation was paid to companies that prevailed in disputes with the national company in arbitration courts. In light of this information, FACIAS requested that the Ministry of Finance confirm whether any recourse action has been initiated to recover this damage, as stipulated by law.
In May 2024, the Ministry of Finance registered a request for information from the FACIAS. Initially, the Ministry indicated that it would provide the requested data within the legal timeframe, but did not do so.
A review of the data from CNAIR reveals that hundreds of millions of euros in compensation have been paid, either for breaches or breaches of contracts, or simply for gross incompetence.
Given the considerable sums of money involved, FACIAS considers that the general public has a legitimate interest in understanding the actions of the Ministry of Finance in these cases.
Furthermore, FACIAS has requested that CNAIR clarify whether any measures have been taken to identify the responsible parties and hold them accountable for these lost disputes. The company's response provides a comprehensive illustration of the extent of the problem and the lack of regard for public funds. "This is not the case."
