The Foundation For The Defense Of Citizens Against State Abuses (FACIAS) is calling on the Ministry of Transport to inspect CNAIR, following multiple messages from citizens about the damage that the stuttering of state institutions is causing to Romanians who happen to own property in areas where roads and motorways are planned to be built on paper.
We are talking about the abuses of the National Road Infrastructure Management Company (CNAIR) that damage both citizens and the public budget.
The construction projects that have been started are accompanied by countless abuses against the owners of the land on which they are to be built. Citizens complain that the land on which public roads are to be built is either expropriated abusively or not compensated in time, and that compensation is awarded far below the market price. There are also situations where, after expropriation, changes occur in the project and the land is returned in whole or in part at a lower value due to damage to the property.
FACIAS has asked the Ministry of Transport to send a control body to CNAIR in order to verify the expropriation procedures concerning properties that have been restituted and how the procedure concerning the protection of property rights has been respected.
Situations where property and property rights are affected
One of the many cases brought to FACIAS's attention through the "It's my right" campaign is that of a landowner who was initially expropriated by CNAIR for a public utility cause. After some time, CNAIR informs him that the expropriation is no longer necessary for the whole area and wants to return part of the land. The citizen in question found that during all the time his property had been in CNAIR's possession, the land had been interfered with, causing him considerable damage. This concerns the damage caused by expropriation: the fence surrounding the property was destroyed and the trees planted on the land were cut down. Basically, CNAIR did not correctly evaluate the area required for expropriation, thus infringing the citizen's private property rights, without compensating him for the damage caused to the land.

FACIAS's "It's my right" campaign is a useful tool for any Romanian, both to raise awareness of fundamental rights and to take action against state abuses. FACIAS invites Romanian citizens who are facing abuses by state institutions to send details of their situation to [email protected]. FACIAS undertakes to analyse each case and to report abuses to the state authorities responsible for dealing with them.
