The Foundation For The Defense Of Citizens Against State Abuses (FACIAS) has notified the Prosecutor's Office attached to the High Court of Cassation and Justice and requested an investigation at the Sinaia City Hospital for the possible commission of the crime of involuntary manslaughter. This move follows up on actions initiated by FACIAS after the tragic death of Claudia Georgiana Secăreanu, a 34-year-old woman who lost her life due to a generalized infection that developed after cholecystectomy surgery.
Although she underwent a laparoscopic procedure, considered minimally invasive, Claudia Georgiana Secăreanu remained hospitalized for 16 days at the Sinaia City Hospital. She was then discharged by Dr. Severius Bărbuță despite persistent pain and still having a drainage tube attached.
The surgeon's conduct after discharge raises serious questions. The doctor delayed the decision to transfer the patient to a higher-level medical facility, even though her condition was visibly deteriorating and the hospital in Sinaia did not have the capacity to carry out the necessary investigations to identify the source of the complications.
In the document submitted to prosecutors, FACIAS outlines the chain of medical errors and therapeutic decisions that culminated in the patient's delayed transfer to Fundeni Hospital in Bucharest, where she arrived in extremely serious condition. The severity of the situation is confirmed by the findings of doctors in the capital, which found that "70% of the liver was a bag of pus", clear evidence of a severe infection that could have been managed differently if action had been taken in time and in accordance with medical protocols.
Hospital representatives unjustifiably attempted to cover up the medical staff's negligence and shift responsibility onto the victim, citing pre-existing conditions that the patient had allegedly not disclosed. Accessing the patient's medical history was a minimum professional obligation and a simple procedure that could have been carried out by querying the medical database.
FACIAS requests that the General Prosecutor's Office take over and directly investigate this case, as there is a risk that a local investigation could be covered up. FACIAS believes that the significant public interest in this case, its complexity, and the need to ensure an effective and impartial investigation require an investigation at the highest level.
FACIAS requested the Ministry of Health to urgently send the Control Body to the Sinaia City Hospital and launch a rigorous investigation into this serious case of malpractice, in order to establish all the circumstances that led to this death, which could have been prevented.
