The Romanian Government, through OUG 147/2020, decided that parents can benefit from days off for child supervision, but in practice one of the conditions laid down by the law makes the provisions of the whole ordinance inapplicable for many families.
The situation has been reported to The Foundation For The Defense Of Citizens Against State Abuses (FACIAS) by many parents, and the main problem for a parent to benefit from days off is related to the need for an affidavit from the other parent. Given that in Romania, according to the most recent census, there are between 14 and 18% single-parent families, it is very often impossible for one parent to obtain such a request from the other parent. FACIAS has asked the Government to amend the text of the law to include single-parent families, including an exception for them, as was provided for in a similar law last year.
FACIAS also calls for the introduction of a new text to regulate the situation of parents with two jobs and the introduction in paragraph 7 to introduce a fine for beneficiaries who have violated the conditions for obtaining paid days off for child supervision.
As it stands, Art.2 paragraph 3 has a legal construction based on the presumption of guilt and bad faith of the beneficiaries of the legal provision, and FACIAS stresses that innocence and good faith are presumed and do not need to be proven.
FACIAS also asks for clarification of the situation of parents with two jobs, as the law in its current form does not expressly state whether the parent can request days off from both jobs.
