The Foundation for the Defense of Citizens Against State Abuses (FACIAS) urges that the Ministry of Health promptly fix certain issues that restrict patients' access to quality medical treatments or increase the number of nosocomial infections in hospitals.
FACIAS uncovered, through the "Romanian patient - fair laws and maximum transparency" project, numerous important laws that cannot be applied and would have significantly improved the quality of the medical act in Romania. This is due to the Ministry of Health failing to establish the rules for the application of the relevant normative acts or failing to issue ministerial orders and Government decisions allowing the subordinate institutions to act in accordance with the new provisions.
Following responses from the Legislative Council to requests made by FACIAS on behalf of residents who submitted reports as part of the "Be Informed, not Abused" project, we discovered that the current position is as follows:
In 2020: There are 39 noteworthy acts (methodological norms, rules, Orders, etc.) that are not carried out by institutions and are directed by laws, ordinances, and emergency ordinances - among these, the Ministry of Health hasn't taken care of 5 normative acts: 3 government decisions and 2 ministerial orders.
In 2021: There are 42 unfinished acts (methodological norms, rules, Orders, etc.) :not carried out by institutions, ordered by laws, ordinances, and emergency ordinances - of these, the Ministry of Health hasn't taken care of 18 normative acts: 4 government decisions and 14 ministerial orders.
Among the laws that the Ministry of Health hasn’t taken care of and therefore can not be enforced are:
- Law no. 3/2021 on the prevention of nosocomial infections. The implementing rules should have been issued as early as July 2021, but they do not exist at the moment.
- Law no. 249/2020 on the prevention and early detection of diabetes.
- Law no. 5/2021 regarding the status of emergency medicine personnel.
- Law no. 584/2002 on measures to prevent the spread of AIDS in Romania
- GEO 46/2021 on the transposition of European Directives and regulations on the medical system.
