The Foundation For The Defense Of Citizens Against State Abuses (FACIAS) has once again called on the Romanian Government to prioritise solving one of its serious problems, the failure to implement European directives within time.
FACIAS's work on this started more than a year ago. The authorities have agreed with FACIAS that clear procedures and responsibilities are needed to implement EU directives. One of the replies received from the Romanian Government in December 2022 indicated that FACIAS's request is well-founded and that a Government Decision will be put through the approval process which will respond precisely to the issues raised by FACIAS.
This Government Decision was drafted, but unfortunately FACIAS notes that it contains only regulations of principle that solve nothing.
FACIAS underlines once again the seriousness of the problem of the non-timely implementation of European directives, a phenomenon that has manifested itself since Romania's accession to the EU and for which there is no solution even today, although studies conducted by specialists contacted by FACIAS have shown, concretely, what are the steps to follow.
According to data provided to FACIAS by the Ministry of Foreign Affairs, since Romania's accession 753 infringement proceedings have been launched against our country for failure to implement directives on time. At present Romania has 34 directives pending, for 11 of which the European Commission has launched infringement proceedings.
The fines paid by the Romanian state for these delays in transposing directives into national law are not inconsiderable, with Romania paying €3 million for a single unimplemented directive.
And this time we are talking about the loss of huge amounts of money from the state budget, which could be avoided and for which there is no way to be recovered from those guilty of receiving fines.
Thus, FACIAS has once again called on the Romanian Government to urgently issue a set of concrete, efficient and transparent procedures on the implementation of European directives, as well as clear sanctions for those responsible for the implementation of directives and who do not fulfil their duties.
