Major shortcomings in the way the "List of Shame" published by ANAF is presented and managed.
Although this tool should be useful in increasing transparency and recovering public money, the reality is that, in its current form, the list does not accurately reflect the fiscal situation of large debtors and does not serve the interests of honest citizens who pay their taxes.

What are the conclusions?

FACIAS experts analyzed in detail the more than 2,700 pages of the "List of Shame" and the situation of the 5,491 companies with debts of more than 1 million lei to ANAF, resulting in the following conclusions:

The largest debt owed to the state

  • Bankrupt: ITALIA TOBACCO PRODUCTION S.R.L., tax code 13081201 – 1,478,125,525 RON
  • Insolvent: AGROPONTE SRL,tax code19048301 – 1,470,671,987 RON

Average receivables

  • Average total receivables for all 5,491 companies: 10,747,479 RON

Total amount to be recovered from all companies

  • Total receivables: 59,014,410,281 RON (≈ EUR 11.66 billion)

Legal status of companies

  • Bankruptcy: 2,730 companies
  • Insolvent (not yet declared insolvent): 1639 companies
  • Insolvent 618 companii
  • Unknown status 503 companies
FACIAS proposals:
  1. Total transparency on the part of ANAF:
    • To communicate the date on which these debts became due.
    • To explain the concrete measures taken to recover the money.
    • To justify the reasons why these amounts have not been recovered.
  1. Responsibility of the supervisory authorities:
    • Why were state-owned companies allowed to accumulate huge debts?
    • Why did managers continue to receive allowances even though the companies were collapsing?
  2. Reform of insolvency legislation:
    • So that the state can effectively and efficiently recover the debts that have been accumulated.
The FACIAS initiative

The aim of the campaign "Who is responsible for the debtors on the List of Shame?" is to encourage the authorities to focus their attention on large debtors and recover unpaid public money, instead of putting additional pressure on honest citizens.

For a clear and relevant picture, FACIAS has reconstructed this list, presenting:

  • Debtors ranked by amount of outstanding debt;
  • Current legal status (suspended activity, insolvency, bankruptcy, etc.);
Questions and answers

According to information published by ANAF, the largest debt is held by ITALIA TOBACCO PRODUCTION S.R.L., tax registration code 13081201, with total debts amounting to RON 1,478,125,525, which is in bankruptcy.

The largest debt owed to an INSOLVENT company (which has not yet entered into insolvency) is owed by AGROPONTE SRL, tax registration code 19048301, with total unrecovered debts of RON 1,470,671,987.

According to the data presented in the table, the average total receivables of all 5,491 companies is RON 10,747,479.

According to the data in the table, the total amount of receivables for all 5,491 companies included in the list is RON 59,014,410,281 (EUR 11,664,080,163) – approximately EUR 11.6 billion.

According to current data, these 5,491 companies include:

  • 2,730 companies in bankruptcy
  • 1639 insolvent companies (which have not yet entered insolvency)
  • 618 companies in insolvency
  • 503 companies whose status is not specified.
