Romania is losing more than 600 million euros following the Pfizer vaccine contract, and each day of delay can add another approximately 150,000 euros to the bill. In this context, the Foundation for the Defence of Citizens Against State Abuses (FACIAS) will sue the Romanian Government if it does not initiate procedures to recover damages from the persons responsible for assuming contractual obligations.
FACIAS cere Guvernului ca suma de peste 600 de milioane de euro, stabilită în urma hotărârii Tribunalului francofon din Bruxelles, să nu fie suportată de români, ci să fie recuperată de la persoanele care au semnat, aprobat sau asumat obligațiile contractuale care au expus România la această pierdere enormă. Potrivit informațiilor publice analizate de FACIAS, hotărârea este executorie, iar întârzierea executării poate genera dobânzi de aproximativ 150.000 de euro pe zi, ceea ce înseamnă peste 1 milion de euro într-o singură săptămână.
In the submitted preliminary complaint, FACIAS requested the Government to urgently adopt an administrative act ordering the initiation of procedures to recover the damage suffered by the Romanian state. FACIAS requests the identification of the responsible persons, the promotion of actions for recovery or patrimonial liability against those responsible, and the communication of the actual adopted measures.
The FACIAS approach comes after Romania was forced by the Belgian court to execute the purchase contract for 28,940,613 doses of the Pfizer vaccine, by paying an amount of approximately 600 million euros.
The Government must clearly state how it will manage the obligation established by the Belgian court: where the amount of over 600 million euros will be recovered from, whether it will attempt to renegotiate, stage or transform this obligation into other products with future delivery. At the same time, the Government must communicate the exact budgetary impact, the initiated recovery measures, the persons identified as responsible, the administrative acts issued and the timetable for future measures.
Romania cannot afford to have the 600 million euro damages caused by decisions taken at the top of the state silently covered with public money. The people who signed, approved or maintained damaging contractual obligations for the Romanian state must be held accountable.
If the Government does not respond within the legal period of 30 days and does not initiate the requested procedure, FACIAS will notify the administrative court to oblige the Government of Romania to fulfil these legal obligations.
