Although more than six years have passed since the entry into force of Law No. 50/2020, the procedure by which 4% of the amounts collected by the state from gambling operators was to be transferred to the Cinematographic Fund has not yet been regulated.

The Foundation for the Defence of Citizens Against State Abuses has requested the Ministry of Finance to urgently develop the procedure without which the National Agency for Fiscal Administration cannot make the transfers provided under the law in order to support the Romanian film and the cinematographic industry.

According to the law, the amount must be transferred by the National Agency for Fiscal Administration by the 31st of May of each year, for the previous year. In order for this mechanism to be enforced, the Ministry of Finance was obliged to develop the necessary procedure within 10 days of the law's entry into force.

Although the state collected taxes from the gambling industry, the amounts supposed to reach the Cinematographic Fund no longer followed the circuit provided by law and were not transferred to the Romanian Cinematography.

The underfinancing issue of Romanian cinematography was recently also highlighted by director Cristian Mungiu, winner of the Palme d'Or at Cannes 2026 with the film "Fjord". The director drew attention to the fact that the Cinematographic Fund is underfinanced, including because certain amounts provided for by law are not collected. According to estimates, the amount that should be redirected to the cinematographic industry would exceed 130 million euros.

Through the preliminary complaint sent to the Ministry of Finance, FACIAS requests the issuance of the administrative act necessary for the enforcement of Law no. 50/2020. If the ministry does not fulfil its obligation to issue the norms within 30 days, FACIAS will notify the administrative court to oblige it to develop the procedure.
