The Foundation For The Defense Of Citizens Against State Abuses (FACIAS) informs those who consider that they have been wrongly fined and wish to contest the fines received under military ordinances, what are the steps to follow for such an action. The persons concerned can lodge an appeal with the court in the territorial district of the place where the offence was sanctioned.
The appeal must be lodged within 15 days of the notification of the report, together with a series of documents: copies of the report and identity card, other relevant documents and proof of payment of a 20 Lei stamp duty (payable at a post office or CEC Bank branch).
You can pay half the amount of the fine within 15 days from the date of notification of the report, and if you are successful in court the amount will be recovered.
Important to note: if a period of 2 months has passed without your being served with the fine notice, enforcement of the fine notice is time-barred.
In support of the appeal, the CCR decision, which admitted the exception of unconstitutionality of Ordinance 34/2020, amending and supplementing Ordinance 1/1999, can also be invoked.
Citizens should also be aware that fines imposed on the basis of legal provisions declared unconstitutional will not be automatically annulled, but only in court.
