Persons who hold or have held public positions , public ands civil officials, and contractual staff within the Ministry of Public Finance, the National Agency for Fiscal Administration, and its subordinate units have the right to be paid their expenses judgment in cases in which they are involved, according to the Order. In the event of a conviction, the Ministry must recover these costs from the convicted person; in the event of an acquittal, the Ministry must recover these costs from the person or institution that brought baseless allegations.
The Ministry of Public Finance responded to FACIAS's express request by explaining that there had been no cases in which the state had recovered the amounts paid.
We're talking about positive discrimination, which turns out to be a privilege reserved for certain categories of civil officials. Furthermore, these legal provisions apply not only to civil officials from the Ministry of Public Finance, the National Agency for Fiscal Administration, and its subordinate units, but also to contractual staff. Essentially, all employees of these institutions.
We believe that the use of these legal instruments, which confer an unjustified privileged status on some, is contrary to fundamental democratic principles.
FACIAS, according to its statutory purpose, but also through its constant activity over the past 14 years, defends the rights of citizens and seeks to ensure transparency in the functioning of state institutions as a principle of democracy and the rule of law.
