The Foundation For The Defense Of Citizens Against State Abuses (FACIAS) has notified the Superior Council of Magistracy and the Judicial Inspection regarding the manner in which the criminal case is being handled against the police officer who, in November 2024, while driving under the influence of alcohol, killed an Olympic student in Poiana Brașov. Ten months later, the case investigating the tragic death of Olympic student Andrei Șerban Ionescu is stalled. Errors during the investigation and unfinished forensic expertise have made it impossible to bring the case to court.
FACIAS examined the documents in the criminal case file opened against police officer Vlad Roșca and found a series of serious irregularities that led to the investigation being blocked and the court's decision being delayed.
In its complaint to the Superior Council of Magistracy and the Judicial Inspection, FACIAS highlights the flawed manner in which preventive measures were handled. Specifically, the defendant Vlad Roșca was released after the prosecutor in charge of the case filed a request to extend his preventive detention one day late, on 21 February 2025, although the legal deadline was 20 February. This procedural error resulted in the defendant's release without any other preventive measures. At the court hearing, it was not the defendant's lawyer, but the prosecutor herself, Mihaela Durnea, who requested the release of the police officer.

Furthermore, although the victim's parents paid the full cost of the forensic examination on 18 June 2025, it was not completed even after the expiry of the three-month period specified in the prosecutor's order, which ended on 18 September 2025. FACIAS requested the Public Prosecutor's Office attached to the Brașov Court to specify the reasons for the delay and the National Institute of Forensic Expertise to explain why the appointed expert did not meet the deadline. At the same time, FACIAS informed the Ministry of Justice about these abuses and delays and asked the minister to take the necessary measures to remedy the situation.
At the same time, FACIAS points out that key witnesses, the young people who called 112 immediately after the accident, have not yet been interviewed, even though their statements could clarify the circumstances surrounding the tragedy. Furthermore, according to information communicated to the victim's father by these witnesses, the criminal investigators who arrived at the scene drove over essential evidence, namely the number plate and skid marks left by the car driven by police officer Vlad Roșca, which raises serious suspicions about compliance with legal procedures. FACIAS has asked the Ministry of Internal Affairs to investigate the actions of the criminal investigators at the scene of the accident, given that there are surveillance cameras around the area that can confirm whether or not legal procedures were followed.
At the same time, FACIAS requested the General Inspectorate of the Romanian Police to disclose what measures had been taken against police officer Vlad Roșca after the accident. FACIAS also asked the Ministry of Internal Affairs to verify whether the Iași County Police Inspectorate had opened a disciplinary investigation against him and whether all measures provided for by law had been applied, including suspension from duty for the duration of the criminal investigation.
FACIAS calls on the Minister of Internal Affairs to take measures to ensure that this case cannot be covered up.
