FACIAS was examined with respect to non-compliance with the principle of random distribution of cases with respect to the appointment of judges in cases where it appeared the incident, procedural, and asked the court to annul the article. 111, par. 3 Hot 1375/2015
APPROACHES:
- FACIAS compiled a national statistic, and following the centralization based on the replies received from the courts of appeal and the courts in Romania, contacted the European Union Agency for Fundamental Rights.
- FACIAS notified the People's Advocate and the Government of Romania;
- FACIAS notified the SCM in order to cancel art. 111 para. 3 of Thief 1375/2015;
- FACIAS sued the SCM for the annulment of the above-mentioned provisions;
- The administrative litigation process with the SCM is currently underway on the role of the Bucharest Court of Appeal.
