The Foundation For The Defense Citizens Of Citizens Against State Abuses (FACIAS) has notified the Public Prosecutor's Office of the High Court of Cassation and Justice regarding acts of a criminal nature committed by officials of the Public Health Department (DSP) Constanta and by doctors of the private hospital Armonia Hospital. The case came to the attention of FACIAS after the death of patient Mădălina Luca, a pregnant woman at maximum medical risk, who recently lost her life as a result of complications after childbirth, due to doctors' decisions and the lack of minimum facilities in intensive care.

Checks carried out by the State Sanitary Inspectorate and the Health Minister's Control Body confirm major abuses and violations of medical procedures. Despite these long-standing deficiencies, DSP Constanta authorized and reauthorized the medical facility between 2009-2025, allowing it to operate despite the fact that the legal provisions were not respected.

The hospital had only a three-bed recovery room without compliant medical circuits, an operating room that did not comply with standards and a transfusion unit where blood was stored in non-validated household refrigerators. In addition, the obstetrics-gynecology ward was closed at the time of the inspection, although it was listed as functional in the DSP's documents. Inspectors also found expired medical products and biocides, unsuitable premises and a lack of essential equipment for major emergencies.

FACIAS has asked the prosecution authorities to verify under what conditions DSP Constanța issued the hospital's sanitary authorization in 2009 for a building intended for hotel use and subsequently renewed the permits, ignoring structural irregularities and lack of intensive care facilities. FACIAS has also asked prosecutors to identify the guilty doctors who participated in the natural childbirth, although it was at maximum risk, failed to obtain proper informed consent for the surgeries and delayed the transfer of Mădălinea Luca to a hospital with full ATI capacity.

FACIAS will continue to monitor this case until the culprits are identified and held accountable.
