The Foundation For The Defense Of Citizens Against State Abuses (FACIAS) signaling, a phenomenon that has intensified in the past few years and the passivity of the Romanian state, in relation to the recovery of the people responsible for the amount of money paid in compensation and fines as a result of the decisions of the ECTHR and the CJEU.

Following FACIAS's requests, the Romanian state institutions informed us that since 2004 and until now more than 99 million euros have been paid as compensation following the Romanian ECHR judgments. In reality, the money paid by the Ministry of Finance, from the state budget and, implicitly, from Romanians' money, is even more. This is because the official amount does not include compensation paid as a result of amicable settlements between the Romanian state and the people whose rights have been violated.

FACIAS proposes the establishment of a legal framework modelled on the Law on the Liability of Judges in the case of damages paid to the ECHR to hold politicians accountable for not exercising their duties in good faith and not transposing European directives.
