The Foundation For The Defense Of Citizens Against State Abuses (FACIAS) draws attention to possible discrimination that could occur in the context of the proposed relaxation measures.

More specifically, this means access to restaurants and hotels, if they are open at 100% capacity, only for people vaccinated with both doses against COVID-19.

According to the proposal, access to individuals will be subject to a prior check of their National Identity Card in a database to see whether or not they are vaccinated.

Such a measure would be a flagrant violation of citizens' rights and freedoms and would be discriminatory under the law.

OUG 137 of 31 August 2000 (republished), clearly defines that citizens have the right to equal treatment and have "the right of access to all places and services intended for public use".

The proposed measure also raises a number of issues related to the processing of personal data under the GDPR.

We believe that the return to normality, i.e. the implementation of the relaxation measures, must be carried out with respect for the law and for all citizens' rights and freedoms. In this context, FACIAS will take all measures to prevent and combat any form of discrimination or abuse, directly or indirectly.
