The Foundation for the Defense of the Citizen Against State Abuses (FACIAS) has sued the Ministry of Investment and European Projects (MIEP) for refusing to provide information on how the National Recovery and Resilience Plan (NRRP) and its annexes were negotiated. This information was requested from the Ministry twice, on 7 February 2023 and 2 March 2023.

FACIAS has decided to go to court after the Minister for European Investment and Projects, Marcel Boloș, himself admitted live on Antena 3 that FACIAS's request for the information and annexes of Romania's National Recovery and Resilience Plan (NRRP) to be de-classified is perfectly legitimate. The Minister said that it is normal to publish Romania's long-term investment plans but that only the Government could decide to declassify these documents. "If such a decision is taken at Government level, we will honour it, it does not depend on the ministry. We don't have much to hide in the NRRP. It is a public document, after all it is Romania's budget and investments that are made in the interest of Romania. We have to be very open, as we are talking about the next generations and the modernisation of Romania," said Bolos.
Despite this statement, coming from the head of the ministry himself, more than two months have passed and the situation has remained unchanged. Under these circumstances, FACIAS believes that the court case is the last resort for a return to normality in this case.
