The Foundation For The Defense Of Citizens Against State Abuses (FACIAS) has succeeded in taking an important step to protect the rights of taxpayers in Romania. FACIAS has prompted ANAF to issue the implementing rules and the modalities of refunding amounts for the cancellation of tax obligations. Although there is a law in this matter, that is Law 43/2023 on the cancellation of tax obligations, which came into force in February, due to the lack of a procedure for refunding amounts wrongly collected, citizens could not benefit from the law's regulations.
The Government and The Parliament have made a habit of issuing legislation that cannot be implemented because the methodological rules are late in being developed. As FACIAS has reported in other cases, there are laws that have been waiting to be implemented for more than a year. A new FACIAS victory has been recorded with regard to Law 43/2023. Because the 30-day deadline had elapsed and the rules had not been drafted, FACIAS filed a preliminary complaint requesting the issuance of the order of the President of ANAF on the regulation of the implementation procedure. Following this request, the authority reacted and sent FACIAS an official reply announcing that the situation complained of had been resolved.
