The Foundation For The Defense Of Citizens Against State Abuses (FACIAS) has referred the matter to the Magistrates' Section regarding the acts of the former chief prosecutor of DNA, Laura Codruța Kovesi, of disclosing secret service information.

FACIAS has asked prosecutors to check the leaks of information to the press through which journalists at ”Evenimentul Zilei” received non-public data from criminal investigations. Journalist Mirel Curea, deputy chief editor at Evenimentul Zilei, made public details of how former DNA chief prosecutor Laura Codruța Kovesi informed some journalists personally, by phone or by e-mail, "in due course, arrests are to be made".

This is not the first time that information on such particularly serious facts has emerged. However, the authorities have so far taken no action.

The leaks to the press are notorious when data on criminal investigations were passed on from the office of Mrs Kovesi, at the time the Prosecutor General of Romania, to journalist Mircea Marian.

It must be established whether Laura Codruța Kovesi's aim in disclosing this non-public information was to obtain unfair personal gain through an image gain in the eyes of the public, or/and to create direct and difficult-to-repair damage to the image and personal life of the persons under investigation and their families, thereby violating the right of the persons concerned to dignity and privacy, as well as to a fair trial and the guarantee of the presumption of innocence.

Given the possibility that these acts may have been committed continuously by Laura Codruța Kovesi, both as Prosecutor General of Romania and as Chief Prosecutor of DNA Bucharest, FACIAS has referred to the competent criminal authorities the possible commission of the offence of "disclosure of service or non-public secrets by the person who knows them due to the duties of his office, if they affect the interests of a person or the activity of a person" provided for in Article 304 NCP.
