The Foundation For The Defense Of Citizens Against State Abuses has taken the National Pensions Office to court for its abusive decision to suspend the annual indexation of pensions. FACIAS' action aims to defend the legal right to pension indexation for almost 4.9 million pensioners, one of the most numerous and vulnerable social categories in Romania.

In the request submitted to the Bucharest Court of Appeal, FACIAS asked the National Pensions Office to order the National Pensions Office to initiate the procedures for the annual indexation of the reference point and to refer the abusive decision to freeze the pension point at the level of 2024 to the Constitutional Court of Romania

For millions of Romanian pensioners, freezing the pension point for the second year in a row represents a loss of income at a time when rising prices have drastically reduced purchasing power. The value of the reference point, the indicator on which pensions are calculated, has been maintained at 81 lei in 2025 and kept at the same level for 2026. Over the same period, the average rate of change in consumer prices was 5.6% in 2024 and 7.3% in 2025, while annual inflation reached 9.3% in February 2026.

This blockage contravenes Art. 84 para. (3) of Law no. 360/2023 on the public pension system, according to which the value of the reference point is increased annually, in January, by the average annual inflation rate and by 50% of the real increase in the average gross wage. However, for the year 2025, the Government maintained the value of the reference point at 81 lei by Emergency Ordinance No 156/2024, and for the year 2026, Article XXXI of Law No. 141/2025 on some fiscal-budgetary measures maintained the same value and postponed the application of indexation until 2027.

In the action filed in court, FACIAS states that, after the previous complaint to the National Pensions Office, the institution refused to intervene, limiting itself to invoking the lack of legislative initiative and to reusing the provisions of the law blocking the indexation, without offering a real solution for the pensioners affected.

FACIAS therefore showed the court that the State has transferred to pensioners the effects of a budgetary decision which contradicts the very law of the public pension system. Indexation is not an administrative favor but the mechanism by which the State protects the real value of the pension against inflation. Given these circumstances, FACIAS calls for the legal indexation mechanism to be applied and for an end to the practice whereby rights expressly provided for by law are successively suspended by abusive fiscal-budgetary acts.

FACIAS will continue all legal steps to defend the rights of the almost 4.9 million Romanian pensioners who are facing an abuse at a time when inflation continues to reduce the real value of their pensions.
