{"id":7461,"date":"2022-03-08T16:35:11","date_gmt":"2022-03-08T16:35:11","guid":{"rendered":"https:\/\/facias.ro\/?p=7461"},"modified":"2022-05-17T10:42:41","modified_gmt":"2022-05-17T07:42:41","slug":"ajutor-public-judiciar","status":"publish","type":"post","link":"https:\/\/facias.ro\/eng\/ajutor-public-judiciar\/","title":{"rendered":"PUBLIC LEGAL AID"},"content":{"rendered":"<p class=\"wp-block-paragraph\"><strong>Duration: January 2022 - June 2022<\/strong><\/p>\n\n\n<ol>\n<li><strong>Context<\/strong><\/li>\n<\/ol>\n<p>The possibility of obtaining public legal aid was established by the O.U.G. no. 51\/2008 and is an additional guarantee of effective access to justice, being adopted to improve the system of facilities and to provide state support to people who represent parties in a legal dispute and are in material difficulty, which would result in an objective inability to bear the costs of legal proceedings.<\/p>\n<p>Referring to <strong>quantum<\/strong>, according to the legal provisions in force at the moment (art. 7), <strong>the amount of public legal aid<\/strong> granted, separately or cumulatively, in any of the forms provided in art. 6 lit. needle), <strong>cannot exceed,<\/strong> during a period of one year, <strong>the maximum amount equivalent to 10 minimum gross salaries per country<\/strong> at the level of the year in which the grant application was made.<\/p>\n<p>By art. 8 is established <strong>criteria <\/strong>after which the public legal aid is granted, in the sense that the beneficiaries are the persons whose <strong>average net monthly income<\/strong> per family member, in the last two months prior to the application, is located <strong>below the level of 300 lei<\/strong>, in which case the amounts constituting public legal aid <strong>it is fully advanced by the state.<\/strong><\/p>\n<p>If the average monthly net income per family member in the last two months prior to the application is <strong>below the level of 600 lei,<\/strong> the amounts of money that constitute public legal aid <strong>is advanced by the state in proportion of 50%.<\/strong><\/p>\n<p><strong>&nbsp;<\/strong><\/p>\n<p>In substantiating the normative act, we consider it necessary to take into account that, at the time O.U.G. no. 51\/2008 was adopted, the minimum gross salary was 500 lei. Compared to this indicator, the two thresholds, of 300 and 600 lei, were at 60% and 120%, respectively.<\/p>\n<p>If we take into account the same benchmark, as the minimum gross salary in 2022 is 2550 lei, applying the same percentages to calculate the two value thresholds for public legal aid, the amounts of <strong>1530 <\/strong>lei and respectively <strong>3060 <\/strong>lei.<\/p>\n<p><strong>&nbsp;<\/strong><\/p>\n<p><u>These threshold amounts were set at the level of 2008 and have remained unchanged. <\/u><\/p>\n<p>As an example, we mention the legislative proposal of a group of parliamentarians, initiated in 2019 but definitively rejected on 08.02.2022 following the legislative process (Pl-x no. 419\/2019), <em>as well as<\/em> the recent legislative initiative of USR MPs Mihai Badea and Oana Murariu, promoted on 15.02.2022.<\/p>\n<ol>\n<li><strong>Project objectives<\/strong><\/li>\n<\/ol>\n<p>Considering that the course of the law in the Romanian Parliament was concluded, taking into account at the same time <em>the need to correlate the value threshold and the conditions for granting public legal aid with the evolution of the economy and the income of the citizens, FACIAS considered <\/em><strong>opportune to propose a legislative intervention of the Romanian Government, in accordance with the provisions of art. 50\/1 of the O.U.G. no. 51\/2008, by which to modify the amounts representing the income limits and the maximum limit that can be granted as public legal aid, provided in art. 7 and, respectively, art. 8 para. (1) and (2).<\/strong><\/p>\n<p>We believe that the establishment of higher value thresholds is beneficial from the perspective of ensuring a balance between the principle of free access to justice and good administration of justice. Even so, the value threshold may be insufficient in relation to economic and legal realities, which have shown us that often setting a value threshold, without other circumstantial elements, does not necessarily ensure free access to a court, more chosen where stamp duties have a high amount. Because, <strong>another<\/strong><strong> option<\/strong> would be that <em>value threshold to refer to a <strong>percentage of the minimum wage in the economy<\/strong>, so its fixed value should be abolished, including a variable factor<\/em>, which take into account the evolution of the economy and the income of citizens.<\/p>\n<p>As such, in relation to all the above, <strong>according to the provisions of art. 50\/1 of the O.U.G. no. 51\/2008, which allow the government to intervene quickly, so that the institution can be given more flexibility in public legal aid, depending on the general economic situation, the standard of living and taking into account the budgetary possibilities, in order to ensure thus the effectiveness of access to justice in order to achieve legitimate rights or interests in court.<\/strong><\/p>\n<p><strong>&nbsp;<\/strong><\/p>\n<p><strong>FACIAS will propose to the Romanian Government the modification of the O.U.G. no. 51\/2008, so that the public legal aid is provided to the institution with greater flexibility, depending on the general economic situation, the standard of living, in order to ensure in this way the effectiveness of
