The Romanian Government has just adopted a Government Ordinance that will allow many abuses by local public authorities, just because it will be possible! The measure has already been notified to the Ombudsman so that it can challenge it in the Constitutional Court!<\/span><\/p>\n

If a central or local public authority considers that a normative act is urgent, it will be able to adopt it without any consultation.<\/span><\/p>\n

The government has even amended the Transparency Law: one word, but enough to change everything: if it is an emergency, the authorities will be able to take action against us before the end of the public consultation! <\/span>putea<\/span> adopta m\u0103suri care ne privesc \u00eenainte de a se termina consultarea public\u0103!<\/span><\/p>\n

We will certainly have a lot of emergencies from now on, to bypass the filter of public opinion! Urgency will be another pretext!<\/span><\/p>\n

The law provided, until three days ago, that: \"draft normative acts are subject to adoption in the emergency procedure provided by the regulations in force.\" <\/span><\/p>\n

(2).<\/span>, in case of an urgent situation or one which, due to its exceptional circumstances, requires the adoption of immediate solutions, in order to avoid a serious prejudice to the public interest, the draft normative acts shall be subject to adoption and before the expiration of that paragraph. \"<\/span><\/p>\n

It is an exception from paragraph (2), art. 7 of the Transparency Law, which stipulates that a new draft normative act must be made public \"at least 30 working days before it is submitted for approval by the public authorities\". <\/span><\/p>\n

Urgen\u021ba nu este clar definit\u0103 \u0219i multe autorit\u0103\u021bi o vor folosi pentru a lua decizii care ne privesc, doar pentru c\u0103 pot! Acesta este riscul! Da, pot fi situa\u021bii ca: r\u0103zboi, cutremur, calamit\u0103\u021bi, dar aceste situa\u021bii nu sunt s\u0103ecificate clar, deci putem avea  tot felul de urgen\u021be!<\/span><\/p>\n

In addition, we just have another amendment to the law without the C.E.S.'s opinion, even though it is advisory.<\/span><\/p>\n
