How do we find out about dedicated rights?<\/li>\n<li>How do these programs help us and where does the money for our treatments come from?<\/li>\n<li>How can we benefit from support through these programs?<\/li>\n<li>Tratarea \u00een str\u0103in\u0103tate, prin decont la Casa de S\u0103n\u0103tate (partea I): Formularul S2 (fost E 112)<\/li>\n<\/ul>\n<p class=\"translation-block\">In this episode we will also talk about our rights in the field of health, when we cannot find salvation in our medical system, i.e. the right to be treated abroad (EU\/EEA\/Swiss Confederation\/United Kingdom of Great Britain and Northern Ireland), when what we have cannot be treated in Romania, with costs borne by the National Health House. However, you should be aware that, in addition to this, there are also situations where we can be treated abroad (when we are in transit or for a period in a country, or when we work abroad on secondment), but we will deal with these only tangentially.<\/p>\n<p>Tratarea \u00een str\u0103in\u0103tate, prin decont la Casa de S\u0103n\u0103tate (partea a III-a), din aceast\u0103 s\u0103pt\u0103m\u00e2n\u0103, cuprinde alte dou\u0103 posibile variante: Prin Ministerul S\u0103n\u0103t\u0103\u021bii &amp; Prin Directiva European\u0103 24.<\/p>\n<p>&nbsp;<\/p>\n<p>\u00cen situa\u021bia \u00een care vrei ca asiguratorul t\u0103u (Casa de S\u0103n\u0103tate) s\u0103-\u021bi pl\u0103teasc\u0103 costurile spitaliz\u0103rii, trebuie sa ob\u021bii o autoriza\u021bie prealabil\u0103 care \u00ee\u021bi ofer\u0103 dreptul s\u0103 fii tratat \u00een acelea\u0219i condi\u021bii \u0219i la acela\u0219i pre\u021b ca \u0219i cet\u0103\u021benii statului \u00een care te deplasezi \u00een scopuri medicale. \u00cen caz contrar, casa de s\u0103n\u0103tate poate refuza cererea de rambursare.<\/p>\n<p>\u00cen situa\u021bia \u00een care c\u0103ut\u0103m un spital din UE care s\u0103 ne asigure \u00eengrijirile medicale de care avem nevoie, este indicat s\u0103 apel\u0103m, ini\u021bial, la casa de asigur\u0103ri de s\u0103n\u0103tate la care suntem asigura\u021bi. Casa de S\u0103n\u0103tate\u00a0 are cele mai multe informa\u021bii \u0219i poate recomanda un spital, av\u00e2nd \u00een vedere ca organismele de asigur\u0103ri de s\u0103n\u0103tate au acorduri speciale cu anumite spitale din str\u0103in\u0103tate.<\/p>\n<h1><span style=\"font-size: 14pt;\">II. Instrumentele care ne asigur\u0103 dreptul de a ne trata \u00een afara \u021b\u0103rii<\/span><\/h1>\n<p>Pentru a ne trata \u00een str\u0103in\u0103tate, prin Casele de s\u0103n\u0103tate, avem trei posibile variante:<\/p>\n<p><strong>Form S2 (formerly E 112)<\/strong><\/p>\n<p><strong>Prin Ministerul s\u0103n\u0103t\u0103\u021bii<\/strong><\/p>\n<p><strong>Through European Directive 24<\/strong><\/p>\n<p>Le vom lua pe r\u00e2nd, \u00eens\u0103, nu uita\u021bi c\u0103 ave\u021bi sursele de informa\u021bii, din acest text, puse la dispozi\u021bie, tocmai pentru c\u0103 acest Ghid Practic dore\u0219te s\u0103 ofere suport de calitate, \u00eens\u0103 nu poate acoperi absolut tot, ci doar acele informa\u021bii esen\u021biale. \u00cen cazul \u00een care v\u0103 afla\u021bi \u00een asemenea situa\u021bii, este bine s\u0103 \u0219ti\u021bi ce drepturi ave\u021bi, cum le ob\u021bine\u021bi, ce ave\u021bi de f\u0103cut \u0219i de unde v\u0103 lua\u021bi informa\u021biile. Acest Ghid Practic este \u0219i un suport care ajut\u0103 \u0219\u0103 \u0219tim de unde ne inform\u0103m, mai am\u0103nun\u021bit.<\/p>\n<p><em>Not\u0103: II.1 este capitolul de s\u0103pt\u0103m\u00e2na trecut\u0103 al ghidului<\/em><\/p>\n<h2><span style=\"font-size: 12pt;\">II.2. Tratament \u00een str\u0103in\u0103tate. PRIN MINISTERUL S\u0102N\u0102T\u0102\u021aII<\/span><\/h2>\n<p>Pa\u0219ii necesari ob\u021binerii fondurilor pentru tratament \u00een str\u0103in\u0103tate, prin Ministerul S\u0103n\u0103t\u0103\u021bii \u00eei reg\u0103sim \u00een\u00a0 Ordinul nr. 50 din 23 ianuarie 2004, al Ministerului S\u0103n\u0103t\u0103\u021bii, privind metodologia de trimitere a unor categorii de bolnavi pentru tratament \u00een str\u0103in\u0103tate (forma la zi), disponibil aici: <a href=\"http:\/\/legislatie.just.ro\/Public\/DetaliiDocument\/49432?isFormaDeBaza=True&amp;rep=True\">http:\/\/legislatie.just.ro\/Public\/DetaliiDocument\/49432?isFormaDeBaza=True&amp;rep=True<\/a>.<\/p>\n<h3><span style=\"font-size: 12pt;\">II.2.1. Ce spune, pe scurt, documentul care reglementeaz\u0103 tratarea \u00een afara \u021b\u0103rii, prin Ministerul S\u0103n\u0103t\u0103\u021bii<\/span><\/h3>\n<p>&nbsp;<\/p>\n<p>Conform Ordinului, trimiterea, \u00een str\u0103in\u0103tate, a bolnavilor este \u00eendeplinit\u0103 de direc\u0163iile de s\u0103n\u0103tate public\u0103 jude\u0163ene (DSP-uri) sau a municipiului Bucure\u015fti \u015fi de Direc\u0163ia general\u0103 de asisten\u0163\u0103 medical\u0103 din cadrul Ministerului S\u0103n\u0103t\u0103\u0163ii.<\/p>\n<p class=\"translation-block\">The referral of patients for treatment abroad is approved by the Ministry of Health only for conditions that cannot be treated in the country, on the basis of medical documentation drawn up by the DSPs.<\/p>\n<p>Sunt accepta\u021bi pentru a se trata afar\u0103,prin aceast\u0103 modalitate,bolnavii cu\u00a0 medic de familie, \u0219i care au parcurs toate etapele posibile aici, \u00een \u021bar\u0103.<\/p>\n<p>Dosarul medical al bolnavului \u00een cauz\u0103 (Documentele medicale ale bolnavului &#8211; copie de pe fi\u015fa pacientului, bilet de ie\u015fire din spital, analize etc.) se depune la DSP-ul arondat, \u00eempreun\u0103 cu o cerere din partea bolnavului sau a apar\u0163in\u0103torului, de c\u0103tre:<\/p>\n<ul>\n<li>the general practitioner or<\/li>\n<li>apar\u0163in\u0103tor (so\u0163\/so\u0163ie, rud\u0103 de gradul IV sau reprezentant legal) sau<\/li>\n<li>patient<\/li>\n<\/ul>\n<p class=\"translation-block\">In the university medical centres of Bucharest, Cluj-Napoca, Ia\u0219i, Craiova, Timi\u0219oara and T\u00e2rgu Mure\u0219, territorial specialist committees are organised, whose chairmen will be appointed by order of the Minister of Health.<\/p>\n<p class=\"translation-block\">The Commission is obliged to start the necessary paperwork within one week of registration of the application.<\/p>\n<p>Comisia de specialitate\u00a0 (prin medicul inspector din cadrul ei) are \u00een sarcin\u0103 coresponden\u0163a cu clinica recomandat\u0103 de comisia de specialitate teritorial\u0103, programeaz\u0103 bolnavul \u015fi ob\u0163ine documente privind costul \u015fi condi\u0163iile de plat\u0103 a tratamentului, precum \u015fi num\u0103rul de cont al clinicii.<\/p>\n<p>Comisia de specialitate are obliga\u021bia ca, \u00een maximum 14 zile de la examinarea cazului, s\u0103 comunice DSP-ului, \u00een scris, concluziile. Pentru nerespectarea acestui termen membrii comisiei r\u0103spund administrativ, civil sau penal, dup\u0103 caz.<\/p>\n<p>Informa\u021biile sunt trimise apoi, de DSP, la Ministerul S\u0103n\u0103t\u0103\u021bii<\/p>\n<p><strong>Cazuri excep\u0163ionale,<\/strong> impuse de natura \u015fi gravitatea bolii, precum \u015fi pentru bolnavii minori: Comisiile de specialitate teritoriale pot recomanda ca bolnavii s\u0103 se deplaseze \u00een str\u0103in\u0103tate cu \u00eenso\u0163itori, costurile deplas\u0103rii \u015fi caz\u0103rii urm\u00e2nd s\u0103 fie suportate de ace\u015ftia, cu excep\u0163ia cazurilor \u00een care bolnavul are v\u00e2rsta cuprins\u0103 \u00eentre 0-1 an.<\/p>\n<p>Decizia trimiterii pentru tratament medical \u00een str\u0103in\u0103tate este luat\u0103, la finalul procesului de mai sus, de o comisie a Ministerului S\u0103n\u0103t\u0103\u0163ii, format\u0103 din ministru, secretar de stat pe probleme de asisten\u0163\u0103 medical\u0103, directorul general al Direc\u0163iei generale asisten\u0163\u0103 medical\u0103 \u015fi directorul Direc\u0163iei rela\u0163ii cu Parlamentul, legisla\u0163ie \u015fi contencios.<\/p>\n<p>\u00cen cazul \u00een care solicit\u0103rile de finan\u0163are a tratamentelor \u00een str\u0103in\u0103tate dep\u0103\u015fesc fondurile aprobate lunar cu aceast\u0103 destina\u0163ie, comisia Ministerului S\u0103n\u0103t\u0103\u0163ii va aproba finan\u0163area tratamentului \u00een str\u0103in\u0103tate pe baza urm\u0103toarelor criterii de prioritate:<\/p>\n<ul>\n<li>riscul vital legat de evolu\u0163ia bolii;<\/li>\n<li>estimated benefit to the patient;<\/li>\n<li>v\u00e2rsta pacientului.<\/li>\n<\/ul>\n<p>\u00cen mare, acestea sunt informa\u021biile pentru tratarea \u00een afara \u021b\u0103rii, decontat\u0103, prin Ministerul S\u0103n\u0103t\u0103\u021bii.<\/p>\n<h3><span style=\"font-size: 12pt;\">II.2.2 Pa\u0219i practici<\/span><\/h3>\n<p>Care sunt pa\u0219ii practice, aplica\u021bi, dac\u0103 noi sau cineva din famile ori apropiat\u00a0 se afl\u0103 \u00een situa\u021bia de a se trata afar\u0103 pentru c\u0103, aici, \u00een \u021bar\u0103 nu se mai poate face ceva, \u00een timp util, sau nu dispunem de cele necesare? Men\u021bion\u0103m c\u0103 ace\u0219tia pot fi f\u0103cu\u021bi de bolnav sau de o rud\u0103 p\u00e2n\u0103 la gradul IV.<\/p>\n<p>&nbsp;<\/p>\n<ol>\n<li>Pacientul\/ apar\u021bin\u0103torul\/ medicul de familie cere medicului curant o scrisoare medical\u0103\/ un raport medical, care s\u0103 spun\u0103 clar: tratamentul\/transplantul de care pacientul are nevoie nu se poate efectua \u00een Rom\u00e2nia (cu motiva\u021bie, ex: nu exist\u0103 banc\u0103 de donatori, nu exist\u0103 tehnic\u0103 necesar\u0103 \u00een Rom\u00e2nia etc.) \u0219i se recomand\u0103 efectuarea tratamentului\/transplantului \u00eentr-o clinic\u0103 din str\u0103in\u0103tate. Documentul are parafa medicului curant \u0219i \u0219tampila spitalului \u00een care este \u00eengrijit bolnavul.<\/li>\n<li>Pacientul\/ apar\u021bin\u0103torul depune la DSP teritorial\u0103 un dosar cu urm\u0103toarele documente:<\/li>\n<\/ol>\n<ul>\n<li>application for referral for treatment abroad<\/li>\n<li>scrisoarea medical\u0103 (\u00een original) primit\u0103 de la medicul curant, de specialitate, privind efectuarea tratamentului \u00een str\u0103in\u0103tate<\/li>\n<li>bilet de ie\u0219ire din spital<\/li>\n<li>medical tests (copy)<\/li>\n<li>I.<\/li>\n<li>copia fi\u0219ei medicale din care sa reias\u0103 clar diagnosticul<\/li>\n<\/ul>\n<p>Pasul este necesar pentru ca DSP s\u0103 \u00eentocmeasc\u0103 dosarul medical pentru ob\u021binerea fondurilor.<\/p>\n<p>Dosarul depus la DSP va avea nr de \u00eenregistrare. Ne not\u0103m \u0219i p\u0103str\u0103m acest num\u0103r de \u00eenregistrare. Vom avea nevoie de el de c\u00e2te ori vorbim, intreb\u0103m, cerem informa\u021bii, solicit\u0103m rezolv\u0103ri\u2026<\/p>\n<ol>\n<li>Dosarul pleac\u0103 (\u00een dou\u0103 zile de la depunerea la DSP) la <strong>Commission<\/strong><\/li>\n<li class=\"translation-block\">The Commission is obliged to start the necessary paperwork within one week of registration of the application.<\/li>\n<li>Comisia de specialitate (prin medicul inspector din cadrul ei) are \u00een sarcin\u0103 coresponden\u0163a cu clinica recomandat\u0103 de comisia de specialitate teritorial\u0103, programeaz\u0103 bolnavul \u015fi ob\u0163ine documente privind costul \u015fi condi\u0163iile de plat\u0103 a tratamentului, precum \u015fi num\u0103rul de cont al clinicii.<\/li>\n<\/ol>\n<p>Realitatea arat\u0103 c\u0103 aici, deseori, \u0219i bolnavul, apar\u021bin\u0103torii, medicul de familie, fac eforturi similare pe l\u00e2ng\u0103 clinici de afar\u0103.<\/p>\n<p>&nbsp;<\/p>\n<ol>\n<li>\u00cen maximum 14 zile de la examinarea cazului, Comisia de specialitate comunic\u0103 DSP, \u00een scris, concluziile. Pentru nerespectarea acestui termen membrii comisiei r\u0103spund administrativ, civil sau penal, dup\u0103 caz.<\/li>\n<li>\u00cen maxim7 zile de la primirea confirm\u0103rii oficiale de la clinica din str\u0103in\u0103tate, Comisia de specialitate transmite DSP documentele oficiale (cu antet \u0219i semnatur\u0103) emise de clinici, \u00een termen de maximum 7 zile lucr\u0103toare (de la data acordului de tratament\/transplant primit de Comisia teritoriala) \u0219i vor cuprinde cel pu\u021bin urm\u0103toarele detalii :<\/li>\n<\/ol>\n<ul>\n<li>Clinic name<\/li>\n<li>Address<\/li>\n<li>Contact person<\/li>\n<li>Phone; Fax; E-mail<\/li>\n<li>Num\u0103rul de cont bancar<\/li>\n<li>Numele \u0219i prenumele pacientului<\/li>\n<li>Diagnosis<\/li>\n<li>Costul evalu\u0103rii medicale a pacientului<\/li>\n<li>Cost of therapeutic procedure applied<\/li>\n<li>Costul evalu\u0103rii medicale a pacientului post tratament<\/li>\n<li>Cost\/day of hospitalisation<\/li>\n<li>Total cost<\/li>\n<li>Condi\u021biile de plata a tratamentului<\/li>\n<li>Data program\u0103rii pacientului pentru internare la tratament\/transplant<\/li>\n<li>DSP transmite dosarul la Comisia de la Ministerul S\u0103n\u0103t\u0103\u021bii spre analiz\u0103 \u0219i aprobare.<\/li>\n<li>Bolnavul pleac\u0103 la tratament, afar\u0103.<\/li>\n<\/ul>\n<p>\u00cen ce prive\u0219te procedurile de plat\u0103, decont, v\u0103 asigur\u0103m c\u0103 ve\u021bi primi informa\u021biile necesare.
