{"id":6829,"date":"2021-10-19T21:14:27","date_gmt":"2021-10-19T18:14:27","guid":{"rendered":"https:\/\/facias.ro\/?p=6829"},"modified":"2022-08-04T10:53:08","modified_gmt":"2022-08-04T07:53:08","slug":"raport-public-de-activitate-in-cadrul-proiectului-pentru-perioada-aprilie-octombrie-2021","status":"publish","type":"post","link":"https:\/\/facias.ro\/eng\/raport-public-de-activitate-in-cadrul-proiectului-pentru-perioada-aprilie-octombrie-2021\/","title":{"rendered":"The Project's Public Activity Report,  April - October 2021"},"content":{"rendered":"<p>Six months after the project's inception, the Foundation for the Defense of Citizens Against State Abuse (FACIAS) publishes the results for April - October 2021.<\/p>\n<p><em>The project's goal is to educate citizens regarding their rights in relation to state institutions; detecting and resolving abuses when they occur; and help them identify the organizations and institutions that may help them combat such abuses. FACIAS provides help and counseling for victims (particularly collective instances) of abuses committed by state institutions upon request, within the limits of its competence, and interacts with state institutions by identifying and promoting good practices in this field. <\/em><\/p>\n<p><em>The initiative implicitly intends to increase the level of accountability and involvement of Romanian citizens in matters of national concern that have as their purpose the violation of their rights by official institutions.<\/em><\/p>\n<p>In the six months since its debut, the Project's content has reached around 330,000 people.<\/p>\n<p><span style=\"font-size: 12pt;\"><strong>The main objectives of the project's activities in the first six months are as follows:<\/strong><\/span><\/p>\n<ul>\n<li>Informing citizens on their rights in respect to state institutions and the legal tools available to them to seek justice: <a href=\"https:\/\/facias.ro\/eng\/proiecte-2\/\">https:\/\/www.facias.ro\/proiecte-2\/<\/a><\/li>\n<li>Analyzing citizen-reported problems and identifying practical solutions<\/li>\n<li>The FACIAS questionnaire: <a href=\"https:\/\/facias.ro\/eng\/chestionar\/?fbclid=IwAR12sWT5ZaQ22RSWHPIKV3p5_Sj0AoVFnONk0wQdaPEPqlc-HPZLGpzsEZo\">https:\/\/www.facias.ro\/chestionar<\/a><\/li>\n<li>The Practical Guide is also built around issues reported anonymously via questionnaire to provide information that the Project audience really needs! In addition, the findings of the Project's six-month report are sent to the ministries coordinating public institutions for which abuses have been identified by respondents.<\/li>\n<li>Student Essay Contest <a href=\"https:\/\/facias.ro\/eng\/proiecte-2\/\">Studen\u021bi \u201dFii informat, nu abuzat!\u201d<\/a> with awards ranging from 3000 to 1000 lei, held between October and December 2021: <a href=\"https:\/\/facias.ro\/eng\/proiecte-2\/\">https:\/\/www.facias.ro\/proiecte-2\/<\/a><\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p><span style=\"font-size: 12pt;\"><strong>FACIAS Questionnaire Cumulative Results at Octobre 2021<\/strong><\/span><\/p>\n<p>The Project Questionnaire includes eight questions, two of which are optional.<\/p>\n<p>The questionnaire has been active since the project's inception (April 2021) and will remain so until it is completed, with the analysis of the responses being updated on a regular basis in accordance with the surveys submitted by the general public.<\/p>\n<p>The age groups into which the respondents fell are listed in the table below.<\/p>\n<p><img fetchpriority=\"high\" decoding=\"async\" class=\"alignnone size-full wp-image-6832\" src=\"https:\/\/facias.ro\/wp-content\/uploads\/2021\/10\/Captura-de-ecran-2021-10-19-205239.png\" alt=\"\" width=\"467\" height=\"274\" srcset=\"https:\/\/facias.ro\/wp-content\/uploads\/2021\/10\/Captura-de-ecran-2021-10-19-205239.png 467w, https:\/\/facias.ro\/wp-content\/uploads\/2021\/10\/Captura-de-ecran-2021-10-19-205239-300x176.png 300w, https:\/\/facias.ro\/wp-content\/uploads\/2021\/10\/Captura-de-ecran-2021-10-19-205239-18x12.png 18w, https:\/\/facias.ro\/wp-content\/uploads\/2021\/10\/Captura-de-ecran-2021-10-19-205239-370x217.png 370w\" sizes=\"(max-width: 467px) 100vw, 467px\" \/><\/p>\n<p>80% of respondents reside within urban areas. 42% believe they know their rights very little or not at all; 47% consider that they understand and know their rights enough; and 9% believe they know their rights very well in relation to state institutions.<\/p>\n<p><img decoding=\"async\" class=\"alignnone size-full wp-image-6833\" src=\"https:\/\/facias.ro\/wp-content\/uploads\/2021\/10\/Captura-de-ecran-2021-10-19-205212.png\" alt=\"\" width=\"467\" height=\"273\" srcset=\"https:\/\/facias.ro\/wp-content\/uploads\/2021\/10\/Captura-de-ecran-2021-10-19-205212.png 467w, https:\/\/facias.ro\/wp-content\/uploads\/2021\/10\/Captura-de-ecran-2021-10-19-205212-300x175.png 300w, https:\/\/facias.ro\/wp-content\/uploads\/2021\/10\/Captura-de-ecran-2021-10-19-205212-18x12.png 18w, https:\/\/facias.ro\/wp-content\/uploads\/2021\/10\/Captura-de-ecran-2021-10-19-205212-370x216.png 370w\" sizes=\"(max-width: 467px) 100vw, 467px\" \/><\/p>\n<p>&nbsp;<\/p>\n<p>10% state that they were not victims of state institution abuse; 47% have encountered a maximum of six instances of abuse in their lives; and 27% claim to have been the victim of such abuse more than seven times. Over all, 74% of respondents claim to have been a victim of abuse committed by state institutions or their representatives at least once.<\/p>\n<p><img decoding=\"async\" class=\"alignnone size-full 370w\" sizes=\"(max-width: 467px) 100vw, 467px\" \/><\/p>\n<p>In regard to where they get information on their rights in relation to state institutions, 32% resort to legislation, 10% directly inquire state institutions, 22% search their rights on the internet, 14% consult relatives, and just 13% consult lawyers.<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"alignnone size-full wp-image-6835\" src=\"https:\/\/facias.ro\/wp-content\/uploads\/2021\/10\/Captura-de-ecran-2021-10-19-205103.png\" alt=\"\" width=\"474\" height=\"299\" srcset=\"https:\/\/facias.ro\/wp-content\/uploads\/2021\/10\/Captura-de-ecran-2021-10-19-205103.png 474w, https:\/\/facias.ro\/wp-content\/uploads\/2021\/10\/Captura-de-ecran-2021-10-19-205103-300x189.png 300w, https:\/\/facias.ro\/wp-content\/uploads\/2021\/10\/Captura-de-ecran-2021-10-19-205103-18x12.png 18w, https:\/\/facias.ro\/wp-content\/uploads\/2021\/10\/Captura-de-ecran-2021-10-19-205103-370x233.png 370w\" sizes=\"(max-width: 474px) 100vw, 474px\" \/><\/p>\n<p>Among those who claim to have been victims of abuse committed by state institutions, 28% filed petitions and complaints; 26% drew the institution's attention through other means (verbally); 11% sought justice, and 22% didn\u2019t act.<\/p>\n<p>&nbsp;<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"alignnone size-full wp-image-6836\" src=\"https:\/\/facias.ro\/wp-content\/uploads\/2021\/10\/Captura-de-ecran-2021-10-19-205036-1.png\" alt=\"\" width=\"476\" height=\"300\"><\/p>\n<p><span style=\"font-size: 12pt;\"><strong>Respondents noticed and reported problems and potential abuses in the following areas: <\/strong><\/span><\/p>\n<ul>\n<li>Justice (approx. 30% of all abuses reported by respondents)<\/li>\n<li>Retrocessions\/inheritances\/trials in court, the tasks of UATs in the field \u2013 they are also found in perceived abuses in justice<\/li>\n<li>In the field of medical services (approx. 15%)<\/li>\n<li>Limitation of rights generated by the pandemic situation (approx. 10%)<\/li>\n<li>Caring for disabled people (approx. 8-9%)<\/li>\n<li>Pensioners' rights (approx. 8-9%)<\/li>\n<li>Relations between citizens and state institutions (approx. 15%)<\/li>\n<li>Taxes &amp; Taxpayer Relations ANAF (approx. 5%)<\/li>\n<li>Employee rights in public institutions (approx. 5%)<\/li>\n<li>Other categories\/abuses reported in questionnaires (approx. 2-3%) \u2013 education, etc.<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p>The following situation arises from the 74% of individuals who reported abuses:<\/p>\n<p><span style=\"font-size: 12pt;\"><strong>Justice <\/strong><\/span><\/p>\n<ul>\n<li>Irregularities in property inheritance trials;<\/li>\n<li>Dissatisfaction with the fact that in most trials, the deceased is held responsible;<\/li>\n<li>Legislation constructed in such a way as to serve the interest of certain groups of citizens;<\/li>\n<li>Citizens who report irregularities feel persecuted and criminalized by the organizations charged with enforcing the law.<\/li>\n<li>Force\/security institutions are viewed as generators of abuses;<\/li>\n<li>Lawsuits are adjudicated in a superficial manner.<\/li>\n<li>Tragedies caused by genuine buyers' repossession in favor of successors (situations involving retroceded assets);<\/li>\n<li>Wrongful expropriation;<\/li>\n<li>Training police investigations; the request from some police officers to withdraw complaints in order not to have open cases, instead of continuing investigations in a professional manner;<\/li>\n<li>Superficial judgment, without checking the originality of the evidence in court;<\/li>\n<li>Citizens feel that they are not equal in rights and obligations;<\/li>\n<li>Changing laws, often through GEO, to create advantages for some social categories at the expense of others;<\/li>\n<li>The unfairness and unprofessionalism of the courts and the lack of fairness in investigations;<\/li>\n<li>The police, including prosecutors, do not take complaints seriously or investigate them professionally, discouraging the population from seeking help;<\/li>\n<li>The litigants claim that those who make justice in the courts are not professionals or serve specific interests, the citizens feel that they are not being served justice;<\/li>\n<li>Abusers are often more protected than their victims;<\/li>\n<li>Dragging the trials to the statute of limitations and feeling that they are wronged during the trials;<\/li>\n<li>Different judicial solutions for similar situations, although the law is the same for all;<\/li>\n<li>Irregularities in property inheritance trials;<\/li>\n<li>Frustrations resulting from the pandemic state and the restriction of certain rights;<\/li>\n<li>Certain services are supplied by faculties, but only on demand, while they should be provided as a principle.<\/li>\n<li>Fines for illegal parking taking into account that Town Halls are not obliged, by law, to provide parking spaces;<\/li>\n<li>Complaints that in lawsuits, the deceased is most often at fault;<\/li>\n<li>Child taken into the care of the state institution without summoning the parties (parents);<\/li>\n<li>Police\/office\/courts prosecutor's - biased, self-serving justice (for example, Courts covering up the pedestrian death case);<\/li>\n<li>Justice demonstrates incompetence, corruption, disinterest.<\/li>\n<li>Refusal of the police to record the objections of those fined;<\/li>\n<li>The policemen break the rules (traffic or during a state of alert), but they punish the citizens for the same violations.<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p class=\"translation-block\"><strong>Retrocessions\/inheritances\/trials in the court, in the field\/UAT tasks in the field - (also found in perceived abuses in the field of justice):<\/strong><\/p>\n<ul>\n<li>Noncompliance by Town Halls with their obligations regarding the release of documentation for the removal of land properties;<\/li>\n<li>Tragedies caused by genuine buyers' repossession in favor of successors (situations involving retroceded assets);<\/li>\n<li>Abusive payments to boost interest groups associated to decision-making factors at the expense of litigants;<\/li>\n<li>Unfair conditions created by retrocession legislation, to which persons who lost litigation (whether tenants or owners) fell victim;<\/li>\n<li>Reappropriation based on interest group criteria;<\/li>\n<li>&#8220;\u00cenc\u0103lcarea legii recuno\u0219tin\u021bei (prevede \u00eempropriet\u0103rire revolu\u021bionari &#8211; LEGE nr. 341 din 12 iulie 2004 a muncitoreasc\u0103 anticomunist\u0103 din Valea Jiului &#8211; Lupeni &#8211; august 1977 )<\/li>\n<li>Expropriation without justification<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-size: 12pt;\"><strong>In the field of medical services:<\/strong><\/span><\/p>\n<ul>\n<li>Patients with other ailments felt neglected and delayed during the pandemic, which may have contributed to worsening health conditions.<\/li>\n<li>The medical act's superficiality\/unprofessionalism;<\/li>\n<li>Failure to respect the dignity of the patient;<\/li>\n<li>Payment for medical services, even though they are provided through the Health Insurance Fund;<\/li>\n<li>Ignorance of patient rights, as well as a lack of information and explanations in common English (mostly about ATI);<\/li>\n<li>Patients are unable to complete their investigations due to a lack of funds<\/li>\n<li>The patient is not treated adequately, with respect;<\/li>\n<li>Abuse: withholding the health contribution in advance and having the taxpayer pay for his health services again if necessary;<\/li>\n<li>Abuse: the child's entitlement to treatment for chronic diseases (cancer and access to a disabled day care center) is restricted.<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p><span style=\"font-size: 12pt;\"><strong>Rights limitations generated by the pandemic situation:<\/strong><\/span><\/p>\n<ul>\n<li>During the pandemic crisis, Town Halls refused staggered tax payment and blocked citizens' accounts, despite the fact that they are, also, affected by the pandemic;<\/li>\n<li>Abusive termination of an employment contract;<\/li>\n<li>Discrimination between vaccinated and unvaccinated people in the context of a pandemic;<\/li>\n<li>The requirement, during a pandemic, to stay at work for 14 consecutive days with the risk of losing one's job if not obeyed;<\/li>\n<li>Some rights are restricted as a result of the state of emergency\/alert;<\/li>\n<li>School masks for children (parents oppose the measure);<\/li>\n<li>Vaccination mandated at institutions because of the risk of job loss;<\/li>\n<li>The vaccinated are concerned about the unvaccinated (the epidemic is spreading);<\/li>\n<li>Discrimination against the unvaccinated.<\/li>\n<\/ul>\n<p><span style=\"font-size: 12pt;\"><strong>Care for individuals with disabilities:<\/strong><\/span><\/p>\n<ul>\n<li>Social workers for people with disabilities are refused employment by municipalities, despite the relevant legislation;<\/li>\n<li>Social and personal assistants for disabled individuals believe they have a right to a raise because they work in challenging conditions, and their pay is not graded.<\/li>\n<li>Wage law 153\/2017 and law 448 for people with disabilities are both inaccurate.<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p><span style=\"font-size: 12pt;\"><strong>Retirement rights (10%):<\/strong><\/span><\/p>\n<ul>\n<li>Differentiated treatment of the majority of retirees, whose legislation is continually changing, and pensioners with special pensions, whose rights are strengthened on the grounds that a right earned cannot be changed;<\/li>\n<li>In terms of pensions, non-compliance with Decree No. 38\/1990 granting rights to railway transport staff<a href=\"http:\/\/legislatie.just.ro\/Public\/DetaliiDocumentAfis\/897\">http:\/\/legislatie.just.ro\/Public\/DetaliiDocumentAfis\/897<\/a>);<\/li>\n<li>Failure to comply with early retirement legislation (Article 65, paragraph 5, provides for early retirement without penalty for persons who have resided in mining districts for 30 years - Partial early retirement | Law 263\/2010);<\/li>\n<li>Unjustified reduction in regular pensions in contrast to special pensions;<\/li>\n<li>Pensions are not being indexed to inflation.<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p><span style=\"font-size: 12pt;\"><strong>&nbsp;<\/strong><\/span><\/p>\n<p class=\"translation-block\"><strong>Relations between citizens and state institutions:<\/strong><\/p>\n<ul>\n<li>State institutions' lack of accountability;<\/li>\n<li>Citizens who report irregularities feel persecuted and criminalized by the organizations charged with enforcing the law.<\/li>\n<li>Public institutions' failure to respond to people' requests;<\/li>\n<li>Violations of the following rights: the right to information, the right to justify an administrative act, the right to impartiality, justice, and proportionality in the analysis of a citizen's request filed to a public entity;<\/li>\n<li>Citizens are asked to produce documents issued by other governmental institutions when they may extract them themselves (needs networked databases).<\/li>\n<li>Blocking access to public information by UAT or central entities;<\/li>\n<li>Failure to respond to inquiries addressed to public institutions (ANAF);<\/li>\n<li>Citizens are being led from door to door;<\/li>\n<li>Contempt and\/or abuse directed at the taxpayer;<\/li>\n<li>UATs also charge for sanitation in deserted areas.<\/li>\n<li>Granting building licenses while failing to follow the requirements;<\/li>\n<li>Citizens without access to technology are directed to download forms from the institutions' websites.<\/li>\n<li>The fee imposed by the local police on elderly persons who sell their own products on the street;<\/li>\n<li>Fines for residents that walk their pets in parks. Children are not permitted on the grass\/rollerblades are not permitted (Vaslui).<\/li>\n<\/ul>\n<p><span style=\"font-size: 12pt;\"><strong>&nbsp;<\/strong><\/span><\/p>\n<p><span style=\"font-size: 12pt;\"><strong>Taxation and Taxpayer Relations ANAF:<\/strong><\/span><\/p>\n<ul>\n<li>Automatic enforcement imposed by authorities on residents with tax delays, without allowing them to pay in installments or late by attaching a penalty;<\/li>\n<li>Lack of information on taxpayers' indebtedness to the state, resulting in fines for late payments;<\/li>\n<li>ANAF abuses - they prey on small businesses;<\/li>\n<li>Excessive labor and income taxation (48% labor taxation\/ 10% income tax, 19% VAT on anything you buy);<\/li>\n<li>Abuse: 10-12 years ago, an employee was reprimanded by ANAF for nonpayment by the employer.<\/li>\n<\/ul>\n<p><span style=\"font-size: 12pt;\"><strong>Employees' rights in public institutions:<\/strong><\/span><\/p>\n<ul>\n<li>Discrimination at work;<\/li>\n<li>Employees allege that their superiors orally encourage them to create\/write various documents that are not part of their job description, and that this backfires on the intimidated because they are the ones who sign;<\/li>\n<li>Employment in government organizations based on non-transparent criteria, including unfair competition.<\/li>\n<\/ul>\n<p><span style=\"font-size: 12pt;\"><strong>&nbsp;<\/strong><\/span><\/p>\n<p><span style=\"font-size: 12pt;\"><strong>Other types of problems and\/or abuses documented in questionnaires<\/strong><\/span><\/p>\n<ul>\n<li>Violation of the rights to an adequate standard of living, good health, and fair justice;<\/li>\n<li>Companies provide subpar services (gas, water, electricity) and do not compensate customers for inconvenience; instead, if residents do not pay on time, their service is automatically interrupted and they are penalized.<\/li>\n<li>Non-compliance with GDPR;<\/li>\n<li>Difficulties repaying loans as a result of the pandemic condition;<\/li>\n<li>Combating disinformation necessitates that the public take the time to properly inform themselves and spot incorrect information.<\/li>\n<li>Increase rents for state housing (to 560 lei\/month);<\/li>\n<li>Students in high school feel deprived of their independence (even adults are not permitted to leave high school premises);<\/li>\n<li>The College of Physiotherapists - abusive behavior (removes members' right to practice, the Ministry of Health does not fulfill its duties - the Ministry of Health gives no response, despite the fact that it is required to take measures under Law 226\/2016);<\/li>\n<li>Public information is requested regarding state loans in the market and destination, respectively the reporting of how the loans are executed.<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p><span style=\"font-size: 12pt;\"><strong>Significant differences between situations perceived as state abuse and potentially abusive situations<\/strong><\/span><\/p>\n<p>Although 74% of respondents claim and believe they have been victims of abuses committed by state institutions, a preliminary analysis of messages received by FACIAS from citizens shows that approximately 28-30% report difficulties they face, not necessarily abuses of the state, and approximately 10-15% signal a situation of potential abuse committed by a state institution.<\/p>\n<p>The majority of abusive situations reported by respondents do not target group abuses, but rather individual abuses that directly affect them.<\/p>\n<p>FACIAS has received around 1000 messages and comments from residents reporting various challenges they are experiencing since the Project's inception.<\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-size: 12pt;\"><strong>The citizen's practical guide in relation to state institutions<\/strong><\/span><\/p>\n<p class=\"translation-block\">FACIAS provides, in episodes, a Practical Guide as a support for citizens in relation to state institutions, a text supported by current legislation. The Guide has provided information in simple language on the free tools we can use in dealing with state institutions without having to go to court.
