Toate informa\u021biile au fost aplicate pe situa\u021bia ipotetic\u0103 \u00een care elevii din \u0218coala de pe raza prim\u0103riei X nu au mai primit bursele.<\/p>\n<p>\u00cen acest episod al Ghidului, vom r\u0103m\u00e2ne tot \u00een domeniul elevilor \u0219i al drepturilor lor.<\/p>\n<p>Cum le putem ap\u0103ra noi, p\u0103rin\u021bii, sau cum se pot ap\u0103ra chiar ei atunci c\u00e2nd, la \u0219coal\u0103, le sunt \u00eenc\u0103lcate drepturi? Oric\u00e2t ne-am dori s\u0103 credem c\u0103 nu va fi a\u0219a, realitatea a demonstrat c\u0103 aceste situa\u021bii sunt reale. Dac\u0103 mai mul\u021bi copii au acela\u0219i drept \u00eenc\u0103lcat, atunci vorbim de victime colective \u0219i \u0219tim deja, din capitolul dedicat advocacy, \u00een linii mari, ce putem face.<\/p>\n<p>\u00cen acest material, atingem urm\u0103toarele subiecte:<\/p>\n<ul>\n<li>Cum afl\u0103m care sunt drepturile \u0219i obliga\u021biile elevilor?<\/li>\n<li>De ce este important s\u0103 cunoa\u0219tem drepturile \u0219i \u00eendatoririle elevilor?<\/li>\n<li>Care este legisla\u021bia \u00een baza c\u0103reia putem afla drepturile elevilor \u0219i copiilor?<\/li>\n<li>Care sunt deciden\u021bii c\u0103tre care ne \u00eendrept\u0103m? Cui reclam\u0103m \u0219i ce a\u0219tept\u0103m?<\/li>\n<li>Care sunt pa\u0219ii practici pe care \u00eei parcurgem \u00een a ap\u0103ra drepturile copilului nostru elev?<\/li>\n<li>Care sunt cele mai importante drepturi \u0219i obliga\u021bii ale elevului?<\/li>\n<li>Cum schimb\u0103 demersul nostru modul \u00een care elevul va vedea lucrurile \u0219i va ac\u021biona, pe viitor, pentru a-\u0219i ap\u0103ra singur drepturile \u0219i pentru a-\u0219i respecta \u00eendatoririle asumate, chiar dac\u0103, atunci c\u00e2nd sunt mici nu punem mare accent pe astfel de aspecte?<\/li>\n<\/ul>\n<h1><span style=\"font-size: 14pt;\">&nbsp; &nbsp; I.Cum afl\u0103m care sunt drepturile \u0219i obliga\u021biile elevilor?<\/span><\/h1>\n<p>To\u021bi copiii (elevi sau nu) trebuie s\u0103 \u0219tie c\u0103 au acelea\u0219i drepturi ca \u0219i adul\u021bii, \u00eens\u0103 au nevoie de o aten\u021bie \u0219i o protec\u021bie special\u0103, \u00eentruc\u00e2t sunt mai vulnerabili datorit\u0103 v\u00e2rstei. Elevii \u00ee\u0219i pot cere singuri drepturile sau\/\u0219i prin p\u0103rin\u021bi ori apar\u021bin\u0103tori.<\/p>\n<p>P\u00e2n\u0103 c\u00e2nd elevii sunt suficient de mari s\u0103 lupte singuri cu un abuz, p\u0103rin\u021bii pot face acest lucru \u00een locul celor mici.<\/p>\n<p>\u00cenainte de toate, elevii \u0219i p\u0103rin\u021bii lor \u0219tiu sau afl\u0103 c\u0103 cei mici au drepturi \u0219i \u00eendatoriri.<\/p>\n<p>Acum, la \u00eenceput de an \u0219colar, este nevoie s\u0103 le \u0219tim pentru a identifica abuzul, c\u00e2nd ne lovim de el \u0219i a ne face dreptate.<\/p>\n<p>Da, elevii au drepturi care trebuie respectate \u0219i despre care ar fi bine s\u0103 \u0219tim, tocmai pentru a preveni eventuale abuzuri ale cadrelor didactice, dar \u0219i ale celorlal\u021bi colegi. Realitatea arat\u0103 c\u0103, uneori, drepturile elevilor sunt trecute cu vederea, iar ele sunt \u00een str\u00e2ns\u0103 corela\u021bie cu obliga\u021biile.<\/p>\n<p>Pentru a ne ap\u0103ra drepturile, pentru a evita sau lupta cu un abuz este necesar s\u0103 ne cunoa\u0219tem \u0219i \u00eendatoririle, nu doar drepturile, pentru c\u0103 ele sunt str\u00e2ns legate.<\/p>\n<p>\u00cen materialul de fa\u021b\u0103 red\u0103m, pe scurt, drepturile elevilor pentru ca ei \u0219i p\u0103rin\u021bii s\u0103 \u0219tie unde \u00ee\u0219i g\u0103sesc aceste drepturi reglementate \u0219i ce au de f\u0103cut, ce norme legale trebuie s\u0103 consulte, cine \u00eei poate ajuta, dac\u0103 singuri nu se descurc\u0103.<\/p>\n<p>&nbsp;<\/p>\n<h1><span style=\"font-size: 14pt;\">&nbsp; &nbsp; II.De ce este important s\u0103 cunoa\u0219tem drepturile \u0219i \u00eendatoririle elevilor?<\/span><\/h1>\n<p>Un elev care \u00ee\u0219i cunoa\u0219te drepturile, va \u0219ti mai bine s\u0103 vad\u0103 c\u00e2nd acestea \u00eei sunt \u00eenc\u0103lcate. Normalitatea este ca drepturile sale s\u0103 fie respectate, nu \u00eenc\u0103lcate, dar, cu siguran\u021b\u0103, se va lovi \u0219i de astfel de situa\u021bii.<\/p>\n<p>Foarte important, copilul trebuie s\u0103 \u0219tie s\u0103 respecte \u0219i el drepturile celorlal\u021bi!<\/p>\n<p>Dac\u0103 noi ne asigur\u0103m c\u0103 le sunt respectate drepturile, atunci ei vor \u00eenv\u0103\u021ba de la noi cum s\u0103 fac\u0103 la fel, \u00een viitor.<\/p>\n<h1><span style=\"font-size: 14pt;\">&nbsp; &nbsp;III.Legisla\u021bia \u00een care avem informa\u021bii utile despre drepturile copilului\/elevului:<\/span><\/h1>\n<ul>\n<li>Legea educa\u021biei na\u021bionale nr.1 din 5 ianuarie 2011, disponibil\u0103, gratuit, la <a href=\"http:\/\/legislatie.just.ro\/Public\/DetaliiDocument\/125150\">http:\/\/legislatie.just.ro\/Public\/DetaliiDocument\/125150<\/a><\/li>\n<li>Statutul elevului: <a href=\"http:\/\/legislatie.just.ro\/Public\/DetaliiDocumentAfis\/181089\">http:\/\/legislatie.just.ro\/Public\/DetaliiDocumentAfis\/181089<\/a><\/li>\n<li>Constitu\u021bia Rom\u00e2niei<strong>, <\/strong><a href=\"https:\/\/www.constitutiaromaniei.ro\/art-32-dreptul-la-invatatura\/\"> 32 \u2013 Dreptul la \u00eenv\u0103\u0163\u0103tur\u0103<\/a>: <a href=\"https:\/\/www.constitutiaromaniei.ro\/art-32-dreptul-la-invatatura\/\">https:\/\/www.constitutiaromaniei.ro\/art-32-dreptul-la-invatatura\/<\/a><\/li>\n<li>Regulamentul-cadru din 31 august 2020 de organizare \u0219i func\u021bionare a unit\u0103\u021bilor de \u00eenv\u0103\u021b\u0103m\u00e2nt preuniversitar: <a href=\"http:\/\/legislatie.just.ro\/Public\/DetaliiDocumentAfis\/229849\">http:\/\/legislatie.just.ro\/Public\/DetaliiDocumentAfis\/229849<\/a><\/li>\n<li>Regulamentul-cadru din 30 iulie 2020 privind organizarea \u0219i func\u021bionarea unit\u0103\u021bilor de \u00eenv\u0103\u021b\u0103m\u00e2nt preuniversitar cu statut de unit\u0103\u021bi-pilot, experimentale \u0219i de aplica\u021bie (dac\u0103 este cazul \u0219colii \u00een care \u00eenva\u021b\u0103 elevul): <a href=\"http:\/\/legislatie.just.ro\/Public\/DetaliiDocument\/229521\">http:\/\/legislatie.just.ro\/Public\/DetaliiDocument\/229521<\/a><\/li>\n<li>Hot\u0103r\u00e2re nr.353 din 25 martie 2021 pentru modificarea Hot\u0103r\u00e2rii Guvernului nr. 72\/2013 privind aprobarea normelor metodologice pentru determinarea costului standard per elev\/pre\u0219colar \u0219i stabilirea finan\u021b\u0103rii de baz\u0103 a unit\u0103\u021bilor de \u00eenv\u0103\u021b\u0103m\u00e2nt preuniversitar de stat, care se asigur\u0103 din bugetul de stat, din sume defalcate din T.V.A. prin bugetele locale, pe baza costului standard per elev\/pre\u0219colar: <a href=\"http:\/\/legislatie.just.ro\/Public\/DetaliiDocument\/240193\">http:\/\/legislatie.just.ro\/Public\/DetaliiDocument\/240193<\/a><\/li>\n<li>Contractul educa\u021bional semnat de fiecare apar\u021bin\u0103tor al elevilor, cu \u0219coala, la \u00eenceput de an \u0219colar;<\/li>\n<li>Regulamentul intern al \u0219colii \u00een care \u00eenva\u021b\u0103 elevul: este publicat pe pagina web a \u0219colii respective, obligatoriu;<\/li>\n<li>Informa\u021bii utile pot fi ob\u021binute \u0219i de pe pagina web a Ministerului Educa\u021biei, rubrica \u201d\u00cenv\u0103\u021b\u0103m\u00e2ntul preuniversitar\u201d;<\/li>\n<li>Legea nr. 35\/1997 privind organizarea \u0219i func\u021bionarea institu\u021biei Avocatul Poporului: <a href=\"http:\/\/legislatie.just.ro\/Public\/DetaliiDocument\/11200\">http:\/\/legislatie.just.ro\/Public\/DetaliiDocument\/11200<\/a><\/li>\n<li>Conven\u021bia ONU cu privire la drepturile copilului: <a href=\"http:\/\/legislatie.just.ro\/Public\/DetaliiDocumentAfis\/28981\">http:\/\/legislatie.just.ro\/Public\/DetaliiDocumentAfis\/28981<\/a><\/li>\n<li>Carta drepturilor fundamentale a Uniunii Europene, art.14: <a href=\"https:\/\/fra.europa.eu\/ro\/eu-charter\/article\/14-dreptul-la-educatie\">https:\/\/fra.europa.eu\/ro\/eu-charter\/article\/14-dreptul-la-educatie<\/a><\/li>\n<li>Normele metodologice din 27 mai 2020 de aplicare a prevederilor&nbsp;<a href=\"http:\/\/legislatie.just.ro\/Public\/DetaliiDocumentAfis\/225728\">7 alin. (1^1),<\/a><a href=\"http:\/\/legislatie.just.ro\/Public\/DetaliiDocumentAfis\/225728\">art.56^1<\/a>&nbsp;\u0219i ale&nbsp;<a href=\"http:\/\/legislatie.just.ro\/Public\/DetaliiDocumentAfis\/225728\">pct.6^1 din anexa la Legea educa\u021biei na\u021bionale nr.1\/2011<\/a>, privind violen\u021ba psihologic\u0103 \u2013 bullying:<strong> http:\/\/legislatie.just.ro\/Public\/DetaliiDocumentAfis\/226680.<\/strong><\/li>\n<\/ul>\n<h1><span style=\"font-size: 14pt;\">&nbsp; &nbsp;IV.Institu\u021bii c\u0103tre care ne putem \u00eendrepta pentru a ap\u0103ra interesele copiilor\/ elevilor no\u0219tri &amp; Pa\u0219ii de parcurs<\/span><\/h1>\n<p>S\u0103 spunem c\u0103 elevului i se \u00eencalc\u0103 un drept stipulat \u00eentr-o norm\u0103 legal\u0103. Cu titlu de exemplu, putem parcurge pa\u0219ii de mai jos.<\/p>\n<ul>\n<li>Dac\u0103 vom constata c\u0103 dreptul elevului este \u00eenc\u0103lcat, ne vom adresa, cu sesiz\u0103ri, peti\u021bii, \u00eenainte de toate, \u0219colii. Vom relata cele \u00eent\u00e2mplate, dreptul \u00eenc\u0103lcat, norma legal\u0103 \u00eenc\u0103lcat\u0103, vom solicita m\u0103suri \u0219i r\u0103spuns.<\/li>\n<li>Aceast\u0103 solicitare o transmitem conducerii institu\u021biei de \u00eenv\u0103\u021b\u0103m\u00e2nt \u00een cadrul c\u0103reia dreptul elevului a fost \u00eenc\u0103lcat. Solicitarea o transmitem \u0219i pe e-mail, cu grija ca, la destinatar, s\u0103 trecem c\u00e2t mai multe cadre din conducerea \u0219colii, dar \u0219i cadrul didactic (dac\u0103 un cadru didactic a \u00eenc\u0103lcat dreptul elevului). Este necesar s\u0103 \u00eei inform\u0103m \u00een acela\u0219i timp pe to\u021bi.<\/li>\n<li>Dac\u0103 \u0219coala nu rezolv\u0103 problema, \u00een timp rezonabil pentru noi \u0219i \u00een termenele legale, atunci retransmitem solicitarea noastr\u0103 (\u00een care s\u0103 ar\u0103t\u0103m dovada c\u0103 am apelat \u00eent\u00e2i la \u0219coal\u0103) c\u0103tre inspectoratul \u0219colar.<\/li>\n<li>Putem avea probleme care \u021bin de \u0219coal\u0103, profesori sau probleme care \u021bin de asigurarea mijloacelor materiale care sunt \u00een sarcina autorit\u0103\u021bilor locale.<\/li>\n<li>Dac\u0103 problema \u021bine de autorit\u0103\u021bile locale, atunci, peti\u021bia pentru inspectoratul \u0219colar o transmitem (dac\u0103 este posibil), \u00een acela\u0219i timp, \u0219i Prim\u0103riei responsabile, de exemplu.<\/li>\n<li>Dac\u0103 nici acum nu rezolv\u0103m problema, transmitem peti\u021bia c\u0103tre Ministerul Educa\u021biei, Avocatul copilului sau, \u00een ultim\u0103 instan\u021b\u0103, dac\u0103 problema este mai grav\u0103 \u0219i \u021bine de securitatea elevului, de pild\u0103, putem depune pl\u00e2ngere la Poli\u021bie sau da \u00een judecat\u0103 f\u0103ptuitorul.<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p>A\u0219adar, \u00een linii mari, pentru ap\u0103rarea dreptului elevului ne adres\u0103m unor institu\u021bii ca cele de mai jos:<\/p>\n<ul>\n<li>\u0218coala \u00een care \u00eenva\u021b\u0103 elevul;<\/li>\n<li>Inspectoratul \u0218colar;<\/li>\n<li>Prim\u0103ria \/institu\u021bia care administreaz\u0103 respectiva \u0219coal\u0103;<\/li>\n<li>Ministerul Educa\u021biei;<\/li>\n<li>Poli\u021bia;<\/li>\n<li>Instan\u021bele de judecat\u0103;<\/li>\n<li>Avocatul Copilului (component\u0103 a institu\u021biei Avocatul Poporului).<\/li>\n<\/ul>\n<p><strong><em>Avocatul Copilului ap\u0103r\u0103 drepturile copiilor&nbsp;<\/em><\/strong>\u00een v\u00e2rst\u0103 de p\u00e2n\u0103 la 18 ani, sus\u021bine \u0219i \u00eencurajeaz\u0103 respectarea \u0219i promovarea drepturilor acestora. Avocatul Copilului intervine \u00een situa\u021bii privind abuzuri fizice, psihice, sexuale, dispari\u021bii ale copiilor, fenomenul bullying, s\u0103r\u0103cia, situa\u021bia din centrele de plasament, rela\u021biile \u00een cadrul \u0219colilor \u0219i gr\u0103dini\u021belor, integrarea copiilor cu dizabilit\u0103\u021bi, p\u0103strarea leg\u0103turilor personale dintre copii \u0219i persoanele de care ace\u0219tia sunt ata\u0219a\u021bi, situa\u021bia copiilor cu p\u0103rin\u021bi pleca\u021bi la munc\u0103 \u00een&nbsp;<em>str\u0103in\u0103tate, precum \u0219i \u00een orice situa\u021bie in care drepturile copiilor nu sunt respectate.<\/em><\/p>\n<p><strong><em>Cine se poate adresa Avocatului Copilului?<\/em><\/strong><\/p>\n<p>Copiii \u2013 orice copil care consider\u0103 c\u0103 nu \u00eei sunt respectate drepturile. Orice persoan\u0103 care are cuno\u0219tin\u021b\u0103 de o posibil\u0103 \u00eenc\u0103lcare a drepturilor copiilor.<\/p>\n<h1><span style=\"font-size: 14pt;\">&nbsp; &nbsp;V.Care sunt principalele drepturi ale elevilor?<\/span><\/h1>\n<p>Principalele drepturi ale elevilor reglementate \u00een&nbsp;Statutul Elevului<a href=\"#_ftn1\" name=\"_ftnref1\"><sup>[1]<\/sup><\/a>.<\/p>\n<p>Drepturile elevilor sunt grupate \u00een diferite categorii, dup\u0103 cum urmeaz\u0103:<\/p>\n<ul>\n<li>Drepturile educa\u021bionale;<\/li>\n<li>Drepturile de asociere \u0219i de exprimare;<\/li>\n<li>Drepturile sociale;<\/li>\n<li>Alte drepturi.<\/li>\n<\/ul>\n<p>\u00cendatoririle elevilor sunt \u0219i ele redate \u00een Statutul elevului (articolul 8).<\/p>\n<h2><span style=\"font-size: 12pt;\">V.1. Drepturile educa\u021bionale<\/span><\/h2>\n<ul>\n<li>Accesul gratuit la educa\u021bie \u00een sistemul de \u00eenv\u0103\u021b\u0103m\u00e2nt de stat.<\/li>\n<\/ul>\n<p>Elevul are dreptul s\u0103 mearg\u0103 la \u0219coal\u0103 \u0219i acest drept nu poate fi&nbsp;\u00eengr\u0103dit&nbsp;prin impunerea unor taxe, cel pu\u021bin nu \u00een \u00eenv\u0103\u021b\u0103m\u00e2ntul de stat.<\/p>\n<ul>\n<li>Dreptul de a beneficia de o educa\u021bie de calitate \u00een unit\u0103\u021bile de \u00eenv\u0103\u021b\u0103m\u00e2nt se refer\u0103 la aplicarea corect\u0103 a planurilor-cadru de \u00eenv\u0103\u0163\u0103m\u00e2nt, parcurgerea integral\u0103 a programelor \u015fcolare \u015fi utilizarea, de c\u0103tre cadrele didactice, a celor mai adecvate strategii didactice, \u00een vederea form\u0103rii \u015fi dezvolt\u0103rii competen\u0163elor cheie \u015fi a atingerii obiectivelor educa\u0163ionale stabilite.<\/li>\n<\/ul>\n<p>O educa\u021bie de calitate presupune folosirea unor metode de predare adaptate nevoilor specifice ale elevilor, folosirea unor resurse eficiente \u0219i actualizate.<\/p>\n<ul>\n<li>Dreptul de a studia o limb\u0103 de circula\u0163ie interna\u021bional\u0103, \u00een regim bilingv, \u00een conformitate cu Legea Educa\u0163iei Na\u0163ionale nr.1\/2011.<\/li>\n<\/ul>\n<p>\u00cen func\u021bie de institu\u021bia de \u00eenv\u0103\u021b\u0103m\u00e2nt, aceast\u0103 limb\u0103 de circula\u021bie interna\u021bional\u0103 poate fi engleza \u0219i\/ sau francez\u0103\/ german\u0103, etc.<\/p>\n<ul>\n<li>Dreptul de a nu fi supus vreunei forme de discriminare din partea conducerii \u0219i a personalului didactic sau nedidactic al unit\u0103\u021bii de \u00eenv\u0103\u021b\u0103m\u00e2nt.<\/li>\n<\/ul>\n<p>Nu e acceptat\u0103 vreo form\u0103 de&nbsp;<a href=\"https:\/\/www.avocatoo.ro\/blog\/discriminare-cncd-plangere\/\">discriminare<\/a><a href=\"#_ftn2\" name=\"_ftnref2\"><sup>[2]<\/sup><\/a>, fie c\u0103 vorbim de modul \u00een care elevul se \u00eembrac\u0103, mediul din care vine, parcursul \u0219colar, s\u0103n\u0103tatea, etc. Toate acestea \u0219i multe altele nu sunt tolerate nici din partea profesorilor sau a personalului nedidactic, nici din partea altor elevi. Aici putem consulta Normele metodologice din 27 mai 2020, privind violen\u021ba psihologic\u0103 \u2013 bullying<a href=\"#_ftn3\" name=\"_ftnref3\"><sup>[3]<\/sup><\/a>. Cadrele didactice, \u00een baza legii, sunt instruite pentru a gestiona asemenea situa\u021bii, deci nu pot spune c\u0103 nu au ce s\u0103 fac\u0103, fiind chiar obligate s\u0103 ia m\u0103suri \u0219i s\u0103 le aduc\u0103 la cuno\u0219tin\u021ba elevului\/ p\u0103rintelui.<\/p>\n<ul>\n<li>Dreptul de a nu fi confiscate bunurile personale care nu atenteaz\u0103 la siguran\u021ba personal\u0103 sau a celorlalte persoane din unitatea de \u00eenv\u0103\u021b\u0103m\u00e2nt.<\/li>\n<\/ul>\n<p>Bunurile personale ale elevului nu pot fi re\u021binute f\u0103r\u0103 un motiv bine \u00eentemeiat, nici ca form\u0103 de&nbsp;sanc\u021bionare.<\/p>\n<ul>\n<li>Dreptul de a participa, f\u0103r\u0103 nicio discriminare \u0219i doar din proprie ini\u021biativ\u0103, f\u0103r\u0103 a fi obliga\u021bi de cadre didactice sau de conducerea unit\u0103\u021bii de \u00eenv\u0103\u021b\u0103m\u00e2nt, la concursuri \u0219colare, olimpiade \u0219i alte activit\u0103\u021bi extra\u0219colare.<\/li>\n<\/ul>\n<p>Nu, nota\/ media nu pot fi condi\u021bionate \u0219i nici influen\u021bate de participarea elevului la anumite concursuri \u0219colare.<\/p>\n<ul>\n<li>Dreptul de proprietate intelectual\u0103 asupra rezultatelor ob\u021binute prin activit\u0103\u021bile de cercetare-dezvoltare, crea\u021bie artistic\u0103 \u0219i inovare.<\/li>\n<\/ul>\n<p>Pe rom\u00e2ne\u0219te spus,&nbsp;munca ta \u00ee\u021bi apar\u021bine<a href=\"#_ftn4\" name=\"_ftnref4\"><sup>[4]<\/sup><\/a>.&nbsp;Profesorul nu are dreptul s\u0103-\u0219i atribuie meritele muncii tale sau s\u0103 prezinte rezultatul acestei munci f\u0103r\u0103 s\u0103-\u021bi ofere credite.<\/p>\n<ul>\n<li>Dreptul de a primi rezultatele evalu\u0103rilor scrise \u00een termen de maximum 15 zile lucr\u0103toare.<\/li>\n<\/ul>\n<p>Acesta este un drept deseori \u00eenc\u0103lcat, prin am\u00e2n\u0103ri nejustificate. E dreptul elevului s\u0103 primeasc\u0103 acea not\u0103 \u0219i exist\u0103 un termen estimativ pentru aceasta.<\/p>\n<ul>\n<li>Dreptul de a \u00eenv\u0103\u021ba \u00eentr-un mediu care sprijin\u0103 libertatea de expresie.<\/li>\n<\/ul>\n<p>Da, \u0219i elevul are dreptul la&nbsp;replic\u0103<a href=\"#_ftn5\" name=\"_ftnref5\"><sup>[5]<\/sup><\/a>, la opinie \u0219i profesorii nu pot \u00eengr\u0103di acest drept. Copilul nu este obraznic atunci c\u00e2nd \u00ee\u0219i cunoa\u0219te dreptul \u0219i cere respectarea lui. Rela\u021bia elev-profesor trebuie s\u0103 aib\u0103 la baz\u0103 respectul&nbsp;reciproc.<\/p>\n<h2><span style=\"font-size: 12pt;\">V.2. Drepturile de asociere \u0219i de exprimare<\/span><\/h2>\n<p>Aceste drepturi sunt reglementate \u00een&nbsp;art.8 \u00een Statutul Elevului. Printre principalele drepturi din aceast\u0103 categorie amintim urm\u0103toarele:<\/p>\n<ul>\n<li>Dreptul de&nbsp;a forma, adera \u0219i participa la grupuri,&nbsp;organiza\u021bii,&nbsp;structuri&nbsp;sau mi\u0219c\u0103ri&nbsp;care promoveaz\u0103 interesele elevilor.<\/li>\n<li>Dreptul la protest, pentru elevii din ciclul liceal, \u00een afara orelor de curs.<\/li>\n<li>Dreptul de&nbsp;a participa la \u0219edin\u021bele Consiliului Elevilor.<\/li>\n<li>Dreptul de&nbsp;a fi ales \u0219i de a alege reprezentan\u021bi,&nbsp;f\u0103r\u0103 nicio limitare&nbsp;sau influen\u021bare din partea personalului didactic sau administrativ.<\/li>\n<li>Dreptul de&nbsp;a publica reviste, ziare, bro\u0219uri \u0219i alte materiale informative, precum \u0219i de a le distribui elevilor din unitatea de \u00eenv\u0103\u0163\u0103m\u00e2nt preuniversitar, f\u0103r\u0103 obliga\u021bia unit\u0103\u021bii de \u00eenv\u0103\u021b\u0103m\u00e2nt de a publica materialele. Este interzis\u0103 publicarea \u0219i distribuirea de materiale care aduc atingere securit\u0103\u021bii na\u021bionale, constituie atacuri xenofobe, denigratoare sau discriminatorii.<\/li>\n<\/ul>\n<h2><span style=\"font-size: 12pt;\">V.3. Drepturile sociale<\/span><\/h2>\n<ul>\n<li>Dreptul de a beneficia de tarif redus cu 50% pentru transportul local \u00een comun pe tot parcursul anului calendaristic.<\/li>\n<\/ul>\n<p>Elevii orfani, elevii cu cerin\u021be educa\u021bionale speciale, precum \u0219i cei pentru care s-a stabilit o m\u0103sur\u0103 de protec\u0163ie special\u0103, \u00een condi\u0163iile legii, sau tutel\u0103, beneficiaz\u0103 de gratuitate pentru toate categoriile de transport men\u021bionate mai sus, \u00een conformitate cu prevederile legale \u00een vigoare.<\/p>\n<ul>\n<li>Dreptul de a beneficia de decontarea cheltuielilor de transport, pe baz\u0103 de abonament, \u00een cazul \u00een care nu pot fi \u0219colariza\u021bi \u00een localitatea de domiciliu.<\/li>\n<li>Dreptul de a beneficia de burse&nbsp;<em>sociale, de studiu \u0219i de merit, de performan\u021b\u0103<\/em>, precum \u0219i de ajutoare sociale \u0219i financiare \u00een diverse forme, \u00een conformitate cu prevederile legale \u00een vigoare.&nbsp;Criteriile generale de acordare a burselor se aprob\u0103 prin ordin al Ministrului Educa\u021biei Na\u021bionale \u0219i Cercet\u0103rii \u015etiin\u021bifice.<\/li>\n<li>Dreptul de a beneficia de locuri \u00een tabere \u0219i \u00een \u0219coli de var\u0103\/ iarn\u0103, \u00een condi\u021biile stabilite de autorit\u0103\u021bile competente.<\/li>\n<li>Dreptul la premii, burse, \u015fi alte asemenea stimulente materiale&nbsp;elevilor cu performan\u0163e \u015fcolare \u00eenalte, precum \u015fi celor cu rezultate remarcabile \u00een educa\u0163ia \u015fi formarea lor profesional\u0103 sau \u00een activit\u0103\u0163i culturale \u015fi sportive, asigurate de c\u0103tre stat.<\/li>\n<li>Dreptul la tarife reduse cu 75%&nbsp;pentru accesul lamuzee, la concerte, la spectacole de teatru, de oper\u0103, de film \u015fi la alte manifest\u0103ri culturale \u015fi sportive&nbsp;organizate de institu\u0163iile publice, conform legii.<\/li>\n<\/ul>\n<h2><span style=\"font-size: 12pt;\">V.4. Alte drepturi ale elevilor:<\/span><\/h2>\n<p>Mai avem \u0219i&nbsp;alte drepturi:<\/p>\n<ul>\n<li>Dreptul de&nbsp;acces \u00een incinta unit\u0103\u021bii \u0219colare, \u00een timpul programului, \u00een condi\u021biile legii, f\u0103r\u0103 limit\u0103ri din partea conducerii precum condi\u021bionalitatea de a avea uniform\u0103.<\/li>\n<li>Dreptul de&nbsp;a beneficia, \u00een mod gratuit, de acte \u0219i de documente de studii, \u00een condi\u021biile legii. Unit\u0103\u021bile de \u00eenv\u0103\u021b\u0103m\u00e2nt vor emite documentele solicitate, conform legii.<\/li>\n<li>Dreptul de&nbsp;r\u0103spuns la solicit\u0103rile&nbsp;pentru informa\u021bii de interes public.<\/li>\n<li>Dreptul de&nbsp;a le fi \u00eenregistrate toate cererile scrise \u0219i semnate, \u00een condi\u021biile legii.<\/li>\n<li>Dreptul de&nbsp;a avea profesori numi\u021bi \u00een mod nediscriminatoriu.<\/li>\n<li>Elevii din \u00eenv\u0103\u021b\u0103m\u00e2ntul secundar superior au&nbsp;dreptul de a solicita schimbarea unui cadru didactic al clasei&nbsp;cu sus\u021binerea a dou\u0103 treimi din totalul de elevi ai clasei, printr-o cerere c\u0103tre conducere \u00een care se va prezenta temeiul ac\u021biunii.<\/li>\n<\/ul>\n<p>Parte din elevi sau p\u0103rin\u021bii lor \u0219tiu de aceste drepturi, \u00eens\u0103, v\u0103 suger\u0103m ca atunci c\u00e2nd nu sunte\u021bi siguri, s\u0103 verifica\u021bi \u00een Statutul Elevului, pentru c\u0103 ele sunt adunate la un loc \u0219i e mai u\u0219or de verificat.<\/p>\n<h1><\/h1>\n<h1><span style=\"font-size: 14pt;\">&nbsp; &nbsp;VI.Care sunt principalele obliga\u021bii ale elevilor?<\/span><\/h1>\n<p>\u00cendatoririle elevului se reg\u0103sesc \u00een articolul 12 al Statutului Elevului. \u0218tim, drepturile sunt foarte importante, \u00eens\u0103 ele sunt corelate \u0219i cu ni\u0219te obliga\u021bii ale elevului.<\/p>\n<ul>\n<li>Frecventarea tuturor orelor de curs, fie c\u0103 avem ore \u00een sal\u0103 sau online.<\/li>\n<\/ul>\n<p>Elevul poate absenta motivat. Oricum, reguli despre num\u0103rul de absen\u021be permis, se g\u0103sesc, inclusiv la \u0219coal\u0103.<\/p>\n<ul>\n<li>Frecventarea cursurilor, preg\u0103tirea la fiecare disciplin\u0103 de studiu, datoria de&nbsp;a dob\u00e2ndi competen\u021bele \u0219i de a-\u0219i \u00eensu\u0219i cuno\u0219tin\u021bele prev\u0103zute de programele \u0219colare.<\/li>\n<\/ul>\n<p>Simpla prezen\u021b\u0103 la orele de curs nu e suficient\u0103. Elevul asist\u0103 la cursuri pentru a acumula informa\u021bie.<\/p>\n<ul>\n<li>Obliga\u021bia de a respecta regulamentele \u015fi deciziile unit\u0103\u0163ii de \u00eenv\u0103\u0163\u0103m\u00e2nt.<\/li>\n<\/ul>\n<p>Aceste informa\u021bii le reg\u0103sim \u00een Regulamentul \u0219colii \u0219i \u00een contractul semnat cu \u0219coala, la \u00eenceputul anului \u0219colar. A\u0219a, elevul va putea evita \u00eenc\u0103lcarea acestor reguli, deoarece, necunoa\u0219terea lor nu \u00eel absolv\u0103 de responsabilitate.<\/p>\n<ul>\n<li>Obliga\u021bia de a sprijini activitatea reprezentan\u021bilor elevilor prin furnizarea de informa\u021bii relevante despre diferitele probleme \u00eent\u00e2mpinate \u00een procesul educa\u021bional.<\/li>\n<\/ul>\n<p>Elevul\/ p\u0103rintele trebuie s\u0103 semnaleze problemele, fie c\u0103 acestea \u021bin de cadrele didactice sau de colegii de \u0219coal\u0103. Elevul nu va fi sanc\u021bionat pentru c\u0103 se pl\u00e2nge c\u0103 lucrurile nu merg a\u0219a cum ar trebui. Ar fi o \u00eenc\u0103lcare a drepturilor lui.<\/p>\n<ul>\n<li>Prezentarea carnetului de elev cadrelor didactice pentru trecerea notelor ob\u021binute \u00een urma evalu\u0103rilor.<\/li>\n<\/ul>\n<p>Dac\u0103 elevul nu are carnetul la el, \u00eel anun\u021b\u0103 pe profesor.<\/p>\n<ul>\n<li>Obliga\u021bia de a utiliza manualele \u015fcolare primite gratuit \u015fi de a le restitui \u00een stare bun\u0103, la sf\u00e2r\u015fitul anului \u015fcolar.<\/li>\n<li>Manifestarea \u00een\u021belegerii, a toleran\u021bei \u0219i a respectului fa\u021b\u0103 de \u00eentreaga comunitate \u0219colar\u0103: elevi \u0219i personalul unit\u0103\u021bii de \u00eenv\u0103\u021b\u0103m\u00e2nt.<\/li>\n<\/ul>\n<p>Elevul are nu numai dreptul de a fi tratat cu respect \u0219i considera\u021bie, ci \u0219i obliga\u021bia de a se purta, la r\u00e2ndul s\u0103u, la fel, cu cei din jur.<\/p>\n<ul>\n<li>Respectarea cur\u0103\u0163eniei, a lini\u015ftii \u015fi ordinii \u00een spa\u0163iul \u015fcolar.<\/li>\n<li>Obliga\u021bia de a utiliza \u00een mod corespunz\u0103tor, conform destina\u0163iei stabilite, toate facilit\u0103\u0163ile \u0219colare la care au acces.<\/li>\n<li>Obliga\u021bia de a cunoa\u015fte prevederile Statutului Elevului \u015fi ale Regulamentului de organizare \u0219i func\u021bionare a unit\u0103\u0163ii de \u00eenv\u0103\u0163\u0103m\u00e2nt.<\/li>\n<li>Suportarea contravalorii eventualelor prejudicii aduse bazei materiale puse la dispozi\u021bie de unitatea de \u00eenv\u0103\u021b\u0103m\u00e2nt.<\/li>\n<li>Obliga\u021bia de a informa autorit\u0103\u021bile competente cu privire la existen\u0163a oric\u0103rei situa\u0163ii care ar putea influen\u0163a \u00een mod negativ desf\u0103\u015furarea activit\u0103\u0163ilor educa\u021bionale.<\/li>\n<\/ul>\n<p>Elevul\/ p\u0103rintele lui are nu doar dreptul de a sesiza neregulile, ci \u0219i obliga\u021bia de a face acest lucru. T\u0103cerea nu este o solu\u021bie, pentru c\u0103 situa\u021bia se va dezvolta \u0219i nu se va rezolva de la sine.<\/p>\n<h2><span style=\"font-size: 12pt;\">V.1. Ce se \u00eent\u00e2mpl\u0103 atunci c\u00e2nd elevul nu \u00ee\u0219i respect\u0103 obliga\u021biile?<\/span><\/h2>\n<p>Nerespectarea obliga\u021biilor elevilor atrage aplicarea de&nbsp;sanc\u021biuni.<\/p>\n<p>Sanc\u021biunile pe care le poate primi un elev sunt:<\/p>\n<ul>\n<li>Observa\u021bie individual\u0103;<\/li>\n<li>Mustrare scris\u0103;<\/li>\n<li>Retragerea temporar\u0103 sau definitiv\u0103 a bursei de merit, a bursei sociale, bani de liceu, a bursei profesionale;<\/li>\n<li>Mutarea disciplinar\u0103 la o clas\u0103 paralel\u0103 din aceea\u015fi unitate de \u00eenv\u0103\u021b\u0103m\u00e2nt;<\/li>\n<li>Preavizul de exmatriculare;<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p>Important:<\/p>\n<ul>\n<li>Unitatea de \u00eenv\u0103\u0163\u0103m\u00e2nt preuniversitar sau cadrele didactice&nbsp;nu pot s\u0103 aplice sanc\u021biuni colective. Orice elev poate fi sanc\u021bionat numai pentru propria culp\u0103.<\/li>\n<li>Sanc\u021bionarea elevului sub forma mustr\u0103rii \u00een fa\u021ba colectivului clasei sau al \u0219colii este interzis\u0103 \u00een orice context.<\/li>\n<li>Absen\u021ba \u00een catalog nu este o sanc\u021biune. Nu po\u021bi fi trecut absent pe motiv c\u0103 nu \u021bi-ai \u00eendeplinit una din obliga\u021biile de mai sus, c\u00e2t timp e\u0219ti prezent la curs.<\/li>\n<li>Sanc\u021bionarea sub forma agresiunii fizice de orice fel a elevului este interzis\u0103.
