De unde \u0219i cum ne inform\u0103m \u00een cazul ini\u021biativelor legislative pe textul c\u0103rora dorim s\u0103 aducem observa\u021bii?\u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0<\/a><\/span><\/p>\n<p><span style=\"font-size: 12pt;\"><a href=\"#_heading=h.tyjcwt\">V. Cum urm\u0103rim proiectul de lege, p\u00e2n\u0103 la adoptare, \u00een cazul \u00een care ini\u021biatorul este Guvernul Rom\u00e2niei?\u00a0 \u00a0<\/a><\/span><\/p>\n<p><span style=\"font-size: 12pt;\"><a href=\"#_heading=h.3dy6vkm\">VI. Modific\u0103rile pe care D<\/a><a href=\"#_heading=h.3dy6vkm\">.<\/a><a href=\"#_heading=h.3dy6vkm\"> le considera abu<\/a><a href=\"#_heading=h.3dy6vkm\">z<\/a><a href=\"#_heading=h.3dy6vkm\">ive nu se reg\u0103sesc \u00een ultima form\u0103 a proiectului de lege reclamat\u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0<\/a><\/span><\/p>\n<p>&nbsp;<\/p>\n<p>&nbsp;<\/p>\n<p>\u00cen cadrul proiectului \u201dFii informat, nu abuzat!\u201d primim multe mesaje \u0219i solicit\u0103ri de a interveni \u00een procesul legislativ, \u00een cazul unor proiecte de lege pe care dumneavoastr\u0103 le considera\u021bi, chiar \u0219i par\u021bial, abuzive sau nedrepte.<\/p>\n<p>Noi, ca ONG, avem la dispozi\u021bie acelea\u0219i instrumente ca \u0219i dumneavoastr\u0103. Le vom exemplifica \u0219i pe acestea, pe viitor, \u00eentr-un capitol dedicat, \u00een cadrul Ghidului practic (<a href=\"https:\/\/www.facias.ro\/proiecte-2\/\">https:\/\/www.facias.ro\/proiecte-2\/<\/a>).<\/p>\n<p>P\u00e2n\u0103 atunci, deoarece este nevoie de mult\u0103 munc\u0103, vom \u00eencerca s\u0103 r\u0103spundem, s\u0103pt\u0103m\u00e2nal, unui tip de probleme semnalate de dumneavoastr\u0103. Vom folosi exemple furnizate de dumneavoastr\u0103 \u0219i le vom generaliza abordarea, deoarece aceste instrumente despre care vorbim ne sunt utile, nu doar \u00een cazul unor abuzuri, ci \u0219i c\u00e2nd vrem s\u0103 producem o schimbare, legal, sau s\u0103 oprim demersuri ale institu\u021biilor publice pe care le consider\u0103m injuste.<\/p>\n<p>&nbsp;<\/p>\n<h1><span style=\"font-size: 14pt;\">\u00a0 \u00a0I. Domnul D. consider\u0103 c\u0103 modific\u0103rile ce vizeaz\u0103 pietonii,\u00a0 anun\u021bate de autorit\u0103\u021bi, sunt abuzive<\/span><\/h1>\n<p>&nbsp;<\/p>\n<p>\u00cen acest articol vom vorbi despre ce putem face noi, ca cet\u0103\u021beni, c\u00e2nd afl\u0103m c\u0103 se preg\u0103te\u0219te o lege cu care suntem \u00een dezacord.<\/p>\n<p>&nbsp;<\/p>\n<p>\u00cen urm\u0103 cu ceva timp am primit acest mesaj din partea domnului D.:<\/p>\n<p style=\"text-align: center;\"><em>\u201dM\u0103 numesc D. \u0219i doresc s\u0103 v\u0103 adresez reclama\u021bia, respectiv contesta\u021bia mea la adresa unei viitoare legi care se vrea a fi implementat\u0103 pe teritoriul acestei \u021b\u0103ri. <\/em><\/p>\n<p style=\"text-align: center;\"><em>Este vorba despre legea care sanc\u021bioneaz\u0103 pietonii care au un telefon sau un device \u00een m\u00e2n\u0103 \u00een timpul travers\u0103rii unei intersec\u021bii sau a unei zebre pietonale.<br \/>\n\u00cen cazul \u0219oferilor care se afl\u0103 \u00een trafic, la volan, \u00eenconjura\u021bi de ma\u0219ini, motociclete, biciclete \u0219i pietoni, unde trebuie s\u0103 aib\u0103 o aten\u021bie distributiv\u0103 la toat\u0103 circula\u021bia \u0219i la toate semnele de circula\u021bie, este cu totul altceva.<br \/>\n\u00cen cazul unui pieton, aceast\u0103 lege, va fi categoric abuziv\u0103! Cine este cu ochii, cu g\u00e2ndul, cu aten\u021bia sau cu mintea \u00een alte p\u0103r\u021bi, nu va fi atent, chiar dac\u0103 nu are niciun alt obiect \u00een m\u00e2ini.<\/em><\/p>\n<p style=\"text-align: center;\"><em>Niciun obiect din m\u00e2inile pietonului nu constituie vreo piedic\u0103 \u00een a circula cu maxim\u0103 aten\u021bie \u0219i responsabilitate, oriunde ar traversa sau s-ar afla!<\/em><\/p>\n<p style=\"text-align: center;\"><em>Aten\u021bionez, pe aceast\u0103 cale, c\u0103 prin asemenea legi abuzive, se urm\u0103re\u0219te interzicerea, \u00eempiedicarea \u0219i eliminarea, din ce \u00een ce mai mult, a colect\u0103rii \u0219i imprim\u0103rii de dovezi foto, audio \u0219i video incriminatorii a evenimentelor \u0219i faptelor din spa\u021biul public.<\/em><\/p>\n<p style=\"text-align: center;\"><em>Cer anularea \u0219i interzicerea definitiv\u0103 \u0219i irevocabil\u0103 a unei astfel de legi abuzive!\u201d<\/em><\/p>\n<p>Acesta era mesajul primit de noi. Este drept, nu st\u0103 \u00een puterea unui ONG s\u0103 anuleze o lege, ea av\u00e2nd la \u00eendem\u00e2n\u0103 acelea\u0219i instrumente pentru a \u00eencerca s\u0103 ob\u021bin\u0103 ce dore\u0219te domnul D., ca \u0219i domnia sa. Afl\u0103m mai multe despre cum putem proceda, dac\u0103 suntem \u00een locul domnului D. \u0219i\u00a0 dorim schimbarea prevederilor legate de pietoni reg\u0103site \u00een textul proiectului de lege. Nu avem certitudinea c\u0103 reu\u0219im, dar putem \u00eencerca, \u0219tiind ce avem de f\u0103cut.<\/p>\n<h1><span style=\"font-size: 14pt;\">\u00a0 \u00a0II. Cine are dreptul de a ini\u021bia legi, \u00een Rom\u00e2nia?<\/span><\/h1>\n<p>Orice proiect de lege are un ini\u021biator.<\/p>\n<p>Cine poate ini\u021bia legi \u00een Rom\u00e2nia? Constitu\u021bia<a href=\"#_ftn1\" name=\"_ftnref1\"><sup>[1]<\/sup><\/a>, prin articolul 74\u00a0 ne spune:<\/p>\n<p>\u201dArt. 74 \u2013 Ini\u0163iativa legislativ\u0103<\/p>\n<p>(1) Ini\u0163iativa legislativ\u0103 apar\u0163ine, dup\u0103 caz, Guvernului, deputa\u0163ilor, senatorilor sau unui num\u0103r de cel pu\u0163in 100.000 de cet\u0103\u0163eni cu drept de vot. Cet\u0103\u0163enii care \u00ee\u015fi manifest\u0103 dreptul la ini\u0163iativ\u0103 legislativ\u0103 trebuie s\u0103 provin\u0103 din cel pu\u0163in un sfert din jude\u0163ele \u0163\u0103rii, iar \u00een fiecare din aceste jude\u0163e, respectiv \u00een municipiul Bucure\u015fti, trebuie s\u0103 fie \u00eenregistrate cel pu\u0163in 5.000 de semn\u0103turi \u00een sprijinul acestei ini\u0163iative.<\/p>\n<p>(2) Nu pot face obiectul ini\u0163iativei legislative a cet\u0103\u0163enilor problemele fiscale, cele cu caracter interna\u0163ional, amnistia \u015fi gra\u0163ierea.<\/p>\n<p>(3) Guvernul \u00ee\u015fi exercit\u0103 ini\u0163iativa legislativ\u0103 prin transmiterea proiectului de lege c\u0103tre Camera competent\u0103 s\u0103 \u00eel adopte, ca prim\u0103 Camer\u0103 sesizat\u0103.<\/p>\n<p>(4) Deputa\u0163ii, senatorii \u015fi cet\u0103\u0163enii care exercit\u0103 dreptul la ini\u0163iativ\u0103 legislativ\u0103 pot prezenta propuneri legislative numai \u00een forma cerut\u0103 pentru proiectele de legi.<\/p>\n<p>(5) Propunerile legislative se supun dezbaterii mai \u00eent\u00e2i Camerei competente s\u0103 le adopte, ca prim\u0103 Camer\u0103 sesizat\u0103.\u201d<\/p>\n<p>Dac\u0103 vom dori s\u0103 afl\u0103m mai multe, putem consulta \u00eentreaga SEC\u0162IUNE a 3-a \u2013 Legiferarea &#8211; din Constitu\u021bie.<\/p>\n<h1><span style=\"font-size: 14pt;\">\u00a0 \u00a0III. Legea 52\/2003 oblig\u0103 ini\u021biatorii de legi s\u0103 le pun\u0103 \u00een dezbatere public\u0103, pentru ca noi, cet\u0103\u021benii, s\u0103 putem aduce \u00eembun\u0103t\u0103\u021biri<\/span><\/h1>\n<p>To\u021bi ini\u021biatorii (locali sau centrali) sunt obliga\u021bi de Legea nr 52\/2003 privind transparen\u021ba decizional\u0103 \u00een administra\u021bia public\u0103<a href=\"#_ftn2\" name=\"_ftnref2\"><sup>[2]<\/sup><\/a>\u00a0 s\u0103 pun\u0103 proiectul de lege \u00een dezbatere public\u0103.<\/p>\n<p>\u00cen cazul de fa\u021b\u0103, observ\u0103m c\u0103 este vorba de o propunere de modificare a codului rutier ini\u021biat\u0103 de Guvern, prin Ministerul Afacerilor Interne.<\/p>\n<p>\u00cenainte de toate, ne intereseaz\u0103 varianta la zi<a href=\"#_ftn3\" name=\"_ftnref3\"><sup>[3]<\/sup><\/a> a codului Rutier.<\/p>\n<p>La o prim\u0103 consultare a textului de lege realiz\u0103m c\u0103 modific\u0103rile la care face referire domnul D. nu se reg\u0103sesc \u00een legea \u00een vigoare.<\/p>\n<p>\u00cens\u0103, domnia sa le are de undeva deoarece le-a v\u0103zut \u00een spa\u021biul public<a href=\"#_ftn4\" name=\"_ftnref4\"><sup>[4]<\/sup><\/a>, \u00een \u0219tiri care vorbeau de modificarea codului rutier \u00een sensul celor reclamate de acesta.<\/p>\n<p>Ini\u021biativa de modificare apar\u021binea Ministerului Afacerilor Interne. Cum urm\u0103rim proiectul de lege, p\u00e2n\u0103 la adoptare, \u00een cazul \u00een care ini\u021biatorul este Guvernul Rom\u00e2niei?<\/span><\/h1>\n<p>Dup\u0103 ce am ob\u021binut toate aceste informa\u021bii, le-am consultat, mergem s\u0103 vedem dac\u0103, de la data 26 iulie, Proiectul de lege care ne intereseaz\u0103 a intrat \u00een \u0219edin\u021ba de Guvern, unde ar trebui s\u0103 ajung\u0103, pe ordinea de zi a unei \u0219edin\u021be de Guvern, pentru a fi adoptat\u0103.<\/p>\n<p>Fiind vorba de o Ordonan\u021b\u0103 de Guvern, aceasta va intra \u00een vigoare imediat ce este adoptat\u0103 de Guvern \u0219i publicat\u0103 \u00een Monitorul Oficial. Apoi, textul este trimis \u00een Parlament, unde va intra \u00een traseul legislativ \u0219i unde poate trece \u00een forma Guvernului, poate fi modificat\u0103 sau respins\u0103 (chiar dac\u0103, p\u00e2n\u0103 la acel moment, a produs efecte).<\/p>\n<p>Este posibil s\u0103 nu \u0219tim c\u00e2nd au fost \u0219edin\u021bele de guvern, din 26 iulie p\u00e2n\u0103 ast\u0103zi. Mergem la agenda Guvernului (<a href=\"https:\/\/gov.ro\/\">https:\/\/gov.ro\/<\/a>). Modific\u0103rile pe care D. le consider\u0103 abuzive nu se reg\u0103sesc \u00een ultima form\u0103 a proiectului de lege reclamat.<\/span><\/h1>\n<p>Dup\u0103 ce vom analiza listele cu actele normative adoptate sau de care Guvernul a luat act, vom vedea c\u0103 Proiectul ini\u021biat de Ministerul afacerilor Interne (Proiect de Hot\u0103r\u00e2re pentru modificarea \u0219i completarea Regulamentului de aplicare a Ordonan\u021bei de urgen\u021b\u0103 a Guvernului nr.195\/2002 privind circula\u021bia pe drumurile publice, aprobat prin Hot\u0103r\u00e2rea Guvernului nr.1.391\/2006), nu a fost \u00eenc\u0103 pus pe ordinea de zi .<\/p>\n<p>Ca atare, dup\u0103 ce consult\u0103m ultima form\u0103 a proiectului de lege ini\u021biat de MAI (forma din 26 iulie), vom vedea c\u0103 prevederile legate de pietoni, la care f\u0103cea referire domnul D., nu se reg\u0103sesc \u00een text. \u00cen plus, \u00eenc\u0103 vorbim de o propunere legislativ\u0103, pentru c\u0103 \u00eenc\u0103 nu a fost adoptat\u0103 de Guvern. Teoretic, la acest moment nu prea mai avem instrumente de a interveni noi, ca cet\u0103\u021beni, dar, dac\u0103 totu\u0219i, consider\u0103m ceva injust \u00een ultima form\u0103 a propunerii, putem transmite \u00eenc\u0103, ini\u021biatorului, punctul nostru de vedere, bine argumentat.
