{"id":4136,"date":"2016-05-10T18:38:59","date_gmt":"2016-05-10T15:38:59","guid":{"rendered":"https:\/\/facias.ro\/?p=4136"},"modified":"2016-05-10T18:38:59","modified_gmt":"2016-05-10T15:38:59","slug":"model","status":"publish","type":"post","link":"https:\/\/facias.ro\/eng\/model\/","title":{"rendered":"Situatia supraaglomerarii inchisorilor din Italia  &#8211; solu\u021biile propuse legislative adoptate de statul italian"},"content":{"rendered":"<p style=\"text-align: justify;\">Guvernul Rom\u00e2niei a adoptat, \u00een \u0219edin\u021ba din 27.04.2016, Memorandumul privind calendarul de m\u0103suri necesare pentru \u00eembun\u0103t\u0103\u021birea condi\u021biilor de deten\u021bie \u0219i a sistemului de proba\u021biune.<br \/>\nAceste m\u0103suri sunt necesare pentru evitarea pronun\u021b\u0103rii de c\u0103tre CEDO a unei hot\u0103r\u00e2ri pilot de condamnare a Rom\u00e2niei.<\/p>\n<p style=\"text-align: justify;\">\nAflat\u0103 \u00eentr-o situa\u021bie similar\u0103, acum c\u00e2\u021biva ani, Italia a adoptat urm\u0103toarele m\u0103suri, care pot servi drept exemplu \u0219i Rom\u00e2niei:<\/p>\n<p style=\"text-align: justify;\">\n<p style=\"text-align: justify;\"><strong>Ce spune CEDO?<\/strong><\/p>\n<p style=\"text-align: justify;\">\n<p style=\"text-align: justify;\">In ianuarie 2016, la numai cateva zile dupa publicarea Raportului Avocatului Poporului, Curtea Europeana a Drepturilor Omului avertiza Romania ca risca deschiderea procedura Deciziei Pilot fata de pasivitatea in care statul roman a stat din 2012 in ceea ce priveste conditiile din penitenciare.<\/p>\n<p style=\"text-align: justify;\"><!--more--><\/p>\n<p style=\"text-align: justify;\"><strong>Cum reactioneaza Guvernul Romaniei?<\/strong><\/p>\n<p style=\"text-align: justify;\">\n<p style=\"text-align: justify;\">Confruntat cu iminenta decizie Pilot, Guvernul Romaniei ia 2 masuri:<\/p>\n<p style=\"text-align: justify;\">&#8211;\u00a0\u00a0\u00a0\u00a0\u00a0 a adoptat un memorandum prin care a solicitat CEDO s\u0103 am\u00e2ne pu\u021bin luarea unei decizii pilot, pentru c\u0103 aceasta ar \u00eensemna un cost foarte mare pentru statul rom\u00e2n &#8211; 8 euro pe zi pentru fiecare zi de deten\u0163ie, pentru toate persoanele aflate \u00een condamnare, de la data la care au intrat \u00een condamnare (ceea ce inseamna aprox. 80 de milioane de euro\/an)<\/p>\n<p style=\"text-align: justify;\">&#8211;\u00a0\u00a0\u00a0\u00a0\u00a0 a suspendat , prin ordonan\u021b\u0103 de urgen\u021b\u0103, aplicarea art. 96 (alin 1, litera f) din Legea 254\/2013 referitoare la elaborarea de lucrari stiintifice in penitenciare.<\/p>\n<p style=\"text-align: justify;\">\n<p style=\"text-align: justify;\"><strong>Decizia Pilot in cazul Italiei<\/strong><\/p>\n<p style=\"text-align: justify;\">\n<p style=\"text-align: justify;\">Pe 8 ianuarie 2013 CEDO a emis Decizia Pilot impotriva Italiei pentru supraaglomerare: cauza Torreggiani impotriva Italiei.<\/p>\n<p style=\"text-align: justify;\">\n<p style=\"text-align: justify;\"><strong>Ce sume a platit Italia ca urmare a Deciziei Pilot?<\/strong><\/p>\n<p style=\"text-align: justify;\">&#8211;\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 In 2012 \u2013 120 de milioane de euro<\/p>\n<p style=\"text-align: justify;\">&#8211;\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 In 2013 \u2013 71,28 milioane de euro<\/p>\n<p style=\"text-align: justify;\">\n<p style=\"text-align: justify;\"><strong>Pentru ce a fost condamnata Italia?<\/strong><\/p>\n<p style=\"text-align: justify;\">Curtea a observat ca natura structurala si sistemica de supraglomerare reise clar din termenii prevazuti in declaratia de urgenta emisa de Primul Ministru Italian in 2010.<\/p>\n<p style=\"text-align: justify;\">\n<p style=\"text-align: justify;\">\u00ae\u00a0\u00a0 In memorandumul adoptat in luna aprilie 2016, Ministrul Raluca Pruna vorbeste despre o problema sistemica.<\/p>\n<p style=\"text-align: justify;\">\n<p style=\"text-align: justify;\">Natura structurala a acestei probleme a fost confirmata de faptul ca mai multe sute de aplicatii erau la acel moment pe rolul CEDO, ridicand problema compatibilitatii conditiilor de detentie dintr-un numar de inchisori italiene cu Articolul 3 (interdictia tratamentului inuman si degradant) al Conventiei. Curtea a decis sa aplice procedura de judecata pilot avand in vedere numarul\u00a0 in crestere\u00a0 al persoanelor ingrijorate din Italia si al hotararilor constatatorii privind incalcari care ar putea rezulta in urma aplicarii in cauza.<\/p>\n<p style=\"text-align: justify;\">\n<p style=\"text-align: justify;\">\u00ae\u00a0\u00a0 In 2015 peste 70 de cauze se aflau pe rolul Curtii si vizau conditiile din inchisorile din Romania.<\/p>\n<p style=\"text-align: justify;\">\n<p style=\"text-align: justify;\"><strong>Masuri cerute de catre Curte<\/strong><\/p>\n<p style=\"text-align: justify;\">\n<p style=\"text-align: justify;\">Statul italian a avut la dispozitie o perioad\u0103 de un an pentru a garanta fiec\u0103rui detinut conditii de deten\u021bie cu respectarea articolului 3 din Conven\u021bie, atunci acesta trebuie s\u0103 ac\u021bioneze astfel \u00eenc\u00e2t s\u0103 se reduc\u0103 num\u0103rul de de\u021binu\u021bi, inclusiv prin punerea \u00een aplicare a mai multor m\u0103suri punitive neprivative de libertate \u0219i prin reducerea la minimum a utilizarii arestului preventiv (\u00een Italia mai mult de 40% din de\u021binu\u021bi erau \u00een arest preventiv).<\/p>\n<p style=\"text-align: justify;\">\n<p style=\"text-align: justify;\">CEDO a retinut ca daca spatiul unui detinut este mai mic de 3 mp acest fapt constituie in sine o incalcare grava a conventiei<\/p>\n<p style=\"text-align: justify;\">\n<p style=\"text-align: justify;\">In cauza Torreggiani (in care s-a pronuntat decizia pilot impotriva Italiei) spatiul era de 3 mp si CEDO a retinut ca e o violare a art. 3<\/p>\n<p style=\"text-align: justify;\">In Romania un detinut are la dispozitie mai putin de 2 mp.<\/p>\n<p style=\"text-align: justify;\">\n<p style=\"text-align: justify;\">Desi in penitenciarele din Romania sunt inchise circa 30.000 de persoane, daca ar fi sa respecte spatiul legal de 4 metri patrati pentru fiecare detinut, acestea nu ar putea primi decat 19.000 de persoane.<\/p>\n<p style=\"text-align: justify;\">\n<p style=\"text-align: justify;\">In urma aplicarii unei proceduri de judecata pilot, statul Italian a adoptat un numar de masuri legislative cu scopul de a rezolva problemele structurale privind supraaglomerarea in penitenciare.<\/p>\n<p style=\"text-align: justify;\">\n<p style=\"text-align: justify;\"><strong>Masurile legislative luate de Italia<\/strong><\/p>\n<hr \/>\n<p style=\"text-align: justify;\">Decretul lege nr. 78\/1 iulie 2013 ratificat de legea 94\/2013 (deci dupa pronuntarea deciziei pilot) modificat de legea nr. 94 din 9 august 2013 prevede suspendarea executarii pedepselor mai mici sau egale de 3 ani<\/p>\n<hr \/>\n<p style=\"text-align: justify;\">Decretul se aplica:<\/p>\n<ul style=\"text-align: justify;\">\n<li>Celor care au primit condamnarea definitiva, dar nu au inceput executarea<\/li>\n<li>Celor care mai au de executat mai putin de 3 ani<\/li>\n<li>Celor care mai au de executat mai mult de 3 ani dar care s-au aflat in arest preventiv (durata arestului preventiv se scade din pedeapsa ramasa de executat astfel incat decretul sa ii vizeze si pe el)<\/li>\n<li>Pentru recidivisti, decretul facilita accesul la pedepsele alternative detentiei<\/li>\n<\/ul>\n<p style=\"text-align: justify;\">Masura coincide cu solutia propusa de Av. Poporului in decembrie 2015, in raportul sau.<\/p>\n<p style=\"text-align: justify;\">\n<p style=\"text-align: justify;\"><strong>Alte prevederi:<\/strong><\/p>\n<ul style=\"text-align: justify;\">\n<li>&#8211; dispozitiile din Codul procedura penala care privesc arestul preventiv pentru a limita recursul la aceasta masura. Daca inainte arestul preventiv se aplica pentru infractiuni cu pedeapsa pana la 3 ani, dupa decret se aplica pentru infractiuni cu pedeapsa de pana la 5 ani.<\/li>\n<li>-dispozitiile legii privind organizarea penitenciarelor se modificau: detinutii isi puteau desfasura activitatea in afara inchisorii pentru activitati de munca si pentru activitati de voluntariat in folosul comunitatii.<\/li>\n<li>-pentru recidivisti s-a introdus posibilitatea suspendarii executarii precum si a executarii la domiciliu pentru fractii de pedeapsa scazute<\/li>\n<\/ul>\n<hr \/>\n<p style=\"text-align: justify;\">\n<p style=\"text-align: justify;\">Decretul lege nr. 199\/2010 modificat prin legea nr. 9\/2012<\/p>\n<hr \/>\n<p style=\"text-align: justify;\">In Italia inca din 2010 a fost reglementata ca masura alternativa pedepsei cu inchisoarea \u201eexecutarea la domiciliu\u201d pentru persoanele pentru care pedeapsa ramasa de executat nu depaseste 18 luni. Este o masura similara arestului la domiciliu (aplicabil in cazul persoanelor arestate preventiv \u2013 deci inainte de condamnare).<\/p>\n<p style=\"text-align: justify;\">Executarea la domiciliu consta in obligatia detinutului de a sta la el acasa si de a iesi din casa numai cu autorizatia judecatorului care a aplicat pedeapsa pentru motive bine intemeiate precum sanatate, munca etc.<\/p>\n<p style=\"text-align: justify;\">\n<p style=\"text-align: justify;\">Procedura este simpla, rapida si fara formalitati dupa ce in prealabil judecatorul a verificat criterii generale precum: disponibilitatea unui domiciliu, lipsa unui pericol concret de fuga sau de a comite noi ilegalitati.<\/p>\n<p style=\"text-align: justify;\">\n<hr \/>\n<p style=\"text-align: justify;\">Decretul lege nr. 146 din 23 decembrie 2013 2014 intitulat: \u201eMasuri urgente pentru protetia drepturilor fundamentale ale detinutilor si pentru reducerea controlata a detinutilor\u201d a completat si modificat legea nr. 10 din 21 februarie<\/p>\n<hr \/>\n<p style=\"text-align: justify;\">Masura a fost supranumita \u201cGoleste Inchisori\u201d:<\/p>\n<p style=\"text-align: justify;\">\n<p style=\"text-align: justify;\">Acest decret a fost o consecinta directa a Deciziei Pilot dispuse de CEDO in ianuarie 2013 impotriva Italiei.<\/p>\n<p style=\"text-align: justify;\">\n<p style=\"text-align: justify;\">A fost <strong>prima initiativa legislativa dedicata in intregime rezolvarii situatiei suprapopularii<\/strong> prin masuri menite sa actioneze asupra executarii pedepselor condamnatilor si legate de indicatiile date in urma hotararii Torreggiani.<\/p>\n<p style=\"text-align: justify;\">\n<p style=\"text-align: justify;\">Acest decret prevedea:<\/p>\n<p style=\"text-align: justify;\">1.\u00a0\u00a0\u00a0\u00a0\u00a0 Pedepse mai lejere \u2013 favorizand accesul la masuri extracarcerale<\/p>\n<p style=\"text-align: justify;\">De exemplu: Delictul de trafic de stupefiante[1] era pedepsit inainte cu pedepse mari si cu posibilitate de circumstante atenuante iar dupa decret pedepsele erau micsorate cu posibilitatea de a aplica circumstante agravante.<\/p>\n<p style=\"text-align: justify;\">\n<p style=\"text-align: justify;\">2.\u00a0\u00a0\u00a0 Suprimarea anumitor conditii de limitare a accesului la masurile alternative<\/p>\n<p style=\"text-align: justify;\">Masura de probatiune pentru toxicomani cu program de reabilitare nu putea sa fie acordata mai mult de doua ori in viata unei persoane. Decretul a eliminat aceasta limitare.<\/p>\n<p style=\"text-align: justify;\">\n<p style=\"text-align: justify;\">3.\u00a0\u00a0\u00a0 Accesul mai rapid si mai facil la masura executarii pedepsei la domiciliu (reglementat inca din 2010).<\/p>\n<p style=\"text-align: justify;\">Legea 199\/2010 introdusese executarea pedepsei la domiciliu. Era o lege provizorie ale carei efecte trebuiau sa expire la 31 decembrie 2013. Decretul a eliminat acest termen si <strong>a pastrat executarea la domiciliu ca masura ordinara.<\/strong><\/p>\n<p style=\"text-align: justify;\">\n<p style=\"text-align: justify;\">4.\u00a0\u00a0\u00a0 Bratara electronica \u2013 folosita ca o garantie pentru masura alternativa a executarii pedepsei la domiciliu<\/p>\n<p style=\"text-align: justify;\">Prevederea de masuri electronice de control a condamnatilor supusi executarii la domiciliu a fost\u00a0 facilitata. Inainte, judecatorii trebuiau sa verifice in prealabil disponibilitatea efectiva a acelor dispozitive electronice in cadrul politiei inainte de a hotara executarea la domiciliu. Dupa decret, nu mai trebuiau sa verifice inainte, ci doar sa emita hotararea iar politia era obligata sa aduca dispozitivele respective.<\/p>\n<p style=\"text-align: justify;\">\n<p style=\"text-align: justify;\">5.\u00a0\u00a0\u00a0\u00a0 Reducerea pedepsei cu 45 de zile pentru fiecare semestru din pedeapsa (deci 45 de zile reduse la 6 luni de pedeapsa) daca detinutul a participat la activitati educative<\/p>\n<p style=\"text-align: justify;\">Iar in perioada 1 ianuarie 2010 \u2013 24 decembrie 2015, reducerea a fost de 75 de zile in loc de 45 de zile (mai putin pentru infractiunile grave, carora li s-au aplicat masuri alternative extracarcerale si mai putin pentru cei care au stat mai putin de 6 luni \u2013 ei nu au putut beneficia de reducerea de 75 de zile)<\/p>\n<p style=\"text-align: justify;\">\n<p style=\"text-align: justify;\"><strong>Alte masuri:<\/strong><\/p>\n<p style=\"text-align: justify;\">&#8211;\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 Conform noii legi, in licitatiile publice se preferau firme care angajau detinuti.<\/p>\n<p style=\"text-align: justify;\">\n<p style=\"text-align: justify;\">&#8211;\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0<strong>\u00a0\u00a0 judecatorii de executare a pedepselor &#8211; <em>Magistratura di Sorveglianza<\/em><\/strong><\/p>\n<p style=\"text-align: justify;\">\u00cen Italia, judec\u0103torii de executare a sentin\u021bei (di sorveglianza magistrati) au competen\u021ba de a monitoriza organizarea \u00eenchisorilor, informeaz\u0103 ministrul de justi\u021bie cu privire la cele constatate precum si cu privire la masurile necesare a fi adoptate\u00a0 (\u00een special cu privire la tratamentul educa\u021bional). Ei controleaz\u0103 legitimitatea execut\u0103rii deten\u021biei, decid m\u0103surile de securitate \u0219i direct execu\u021bia, verific\u0103 dac\u0103 au existat \u00eenc\u0103lc\u0103ri ale drepturilor de\u021binu\u021bilor \u0219i hotarasc eliminarea acestor incalcari, isi dau acordul cu privire la\u00a0 permisul de ie\u0219ire din \u00eenchisoare. Tot ei se ocupa in mod direct cu executarea m\u0103surilor alternative la deten\u021bie (eliberarea in probatiune, programul pentru persoanele dependente de droguri, deten\u021bia la domiciliu, zile de eliberare condi\u021bionat\u0103) Acest judecator\u00a0 poate acorda cu titlu provizoriu executarea pedepsei la domiciliu (care este o deten\u021bie la domiciliu pentru pedepse scurte ca timp), o m\u0103sur\u0103 alternativ\u0103 introdusa recent prin lege.<\/p>\n<p style=\"text-align: justify;\">\n<p style=\"text-align: justify;\"><em>In Romania nu exista aceasta institutie.<\/em><\/p>\n<p style=\"text-align: justify;\">\n<p style=\"text-align: justify;\">\n<p style=\"text-align: justify;\">\n<p style=\"text-align: justify;\"><strong>Consecinte directe- in cifre<\/strong><\/p>\n<p style=\"text-align: justify;\">\n<p style=\"text-align: justify;\">Inainte de decizia pilot, Italia avea in penitenciare un grad de supraaglomerare de <span style=\"color: #ff0000;\">151 %<\/span>. Dupa decizia pilot, dupa mai multe masuri legislative si administrative, gradul de supraaglomerare din penitenciarele din Italia a ajuns la <span style=\"color: #ff0000;\"><strong>124%<\/strong><\/span>.<\/p>\n<p style=\"text-align: justify;\">\n<p style=\"text-align: justify;\">In Romania, conform raportului avocatului poporului din decembrie 2015, opt inchisori din Romania au un grad de ocupare mai mare de 200%. 29.952 de detinuti ocupa cele 18.983 de locuri disponibile.<\/p>\n<p style=\"text-align: justify;\">\n<p style=\"text-align: justify;\"><strong>Numar detinuti Italia:<\/strong><\/p>\n<p style=\"text-align: justify;\">iunie 2010 &#8211; <strong>68.258<\/strong> detinuti<\/p>\n<p style=\"text-align: justify;\">ianuarie 2013 (in momentul pronuntarii deciziei pilot Torreggiani) aveau <span style=\"color: #ff0000;\"><strong>66.028<\/strong><\/span><\/p>\n<p style=\"text-align: justify;\">in martie 2014 &#8211; <span style=\"color: #ff0000;\"><strong>60.470<\/strong><\/span> detinuti<\/p>\n<p style=\"text-align: justify;\">De unde rezulta ca in mai putin de un an numarul detinutilor italieni s-a diminuat cu 5.558.<\/p>\n<p style=\"text-align: justify;\">Astfel gradul de suprapopulare a scazut de la 151% cat era in 2010 la 126,4% in 2014 (dupa decizia pilot)<\/p>\n<p style=\"text-align: justify;\">\n<p style=\"text-align: justify;\"><span style=\"text-decoration: underline;\"><strong>Italia a fost obligata sa plateasca peste 200 de milioane de euro<\/strong><\/span> asta desi in perioada 2009-2013 <span style=\"color: #ff0000;\"><strong>pentru peste 17.000 de persoane s-au aplicat pedepse alternative de detentie<\/strong><\/span> (si astfel a scazut numarul persoanelor aflate in detentie) :<\/p>\n<p style=\"text-align: justify;\">&#8211;\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 in decembrie 2009- <span style=\"color: #ff0000;\"><strong>12.455<\/strong><\/span> de persoane erau supuse unor astfel de masuri,<\/p>\n<p style=\"text-align: justify;\">&#8211;\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 in decembrie 2013 numarul lor ajunsese la <span style=\"color: #ff0000;\"><strong>29.223<\/strong><\/span><\/p>\n<p style=\"text-align: justify;\">\n<p style=\"text-align: justify;\">\n<p style=\"text-align: justify;\">\n<p style=\"text-align: justify;\">[1] La nivelul anului 2013, cele mai multe infractiuni vizau traficul de droguri \u2013 aproximativ 36% din total<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Guvernul Rom\u00e2niei a adoptat, \u00een \u0219edin\u021ba din 27.04.2016, Memorandumul privind calendarul de m\u0103suri necesare pentru \u00eembun\u0103t\u0103\u021birea condi\u021biilor de deten\u021bie \u0219i a sistemului de proba\u021biune.
