RESPECT THE ROMANIAN CONSTITUTION!"},"content":{"rendered":"<p style=\"text-align: center;\"><strong>LETTER OPEN<\/strong><\/p>\n<p style=\"text-align: center;\"><strong>IN THE ATTENTION OF LUCIAN BODE, MINISTER OF INTERNAL AFFAIRS<\/strong><\/p>\n<p style=\"text-align: center;\"><strong>Do not remove more than 50 Romanian localities!<\/strong><\/p>\n<p style=\"text-align: center;\"><strong>RESPECT THE ROMANIAN CONSTITUTION!<\/strong><\/p>\n<p style=\"text-align: justify;\"><em>Dear Minister,<\/em><\/p>\n<p style=\"text-align: justify;\">At this point, the fate of hundreds of thousands of Romanians lay in your hands, as is your decision to follow the law. You haven't done it yet, as demonstrated by the extremely unusual occurrence in which you departed a sector of the Capital.<\/p>\n<p style=\"text-align: justify;\">By decree no. 358 issued by the institution of the Prefect of Bucharest, the position of mayor of Sector 5 in Bucharest was vacated on 09.06.2022. By the consecration of the sentence from civil file no. 15826\/3\/2022, the premature termination of the mandate remained final on 12.07.2022.<\/p>\n<p style=\"text-align: justify;\">As a result of the above documents, according to GEO no. 57\/2019 regarding the Administrative Code, \"the elections provided for in para. 1 are organized within 90 days of the issuance of the prefect's order provided for in para. 118 para. 4, under the conditions of the law on the election of local public administrative authorities.\"<\/p>\n<p style=\"text-align: justify;\">You did not comply with the law, Mr. Minister Lucian Bode! Local elections in Sector 5 of the Capital should have taken place no later than October 10, and the Government was required to adopt H.G. regulating election organization no later than September 5, in order to meet the Administrative Code's 90-day deadline.<\/p>\n<p style=\"text-align: justify;\">You have chosen to disregard citizens' right to be represented by a mayor of their choice, you have committed an abuse and an illegality, and we urge you to rectify the situation as soon as possible.<\/p>\n<p>Just like you should do for roughly 50 other Romanian municipalities, some of which do not have a mayor directly chosen by the people since 2021. For example, in:<\/p>\n<ul>\n<li style=\"text-align: justify;\">Jibert (Bra\u015fov) - the mayor was killed by a local councillor in a fight<\/li>\n<li style=\"text-align: justify;\">S\u0103r\u0103\u0163eni (Mure\u015f) - the mayor died asphyxiated in a septic tank<\/li>\n<li style=\"text-align: justify;\">\u015eimian (Bihor) \u2013 the mayor died after falling from a tree<\/li>\n<li style=\"text-align: justify;\">S\u00e2ngeorz-B\u0103i (Bistrita-N\u0103s\u0103ud) \u2013 the mayor was convicted for the second time in a criminal case, for drinking and driving<\/li>\n<li style=\"text-align: justify;\">Valea Salciei (Buz\u0103u) - the mayor was employed at the Court of Accounts<\/li>\n<li style=\"text-align: justify;\">Bl\u00e2ne\u015fti (Boto\u015fani) - the mayor and the vice-mayor found in a conflict of interests<\/li>\n<li style=\"text-align: justify;\">Lop\u0103tari (Buz\u0103u) - the mayor resigned<\/li>\n<\/ul>\n<p style=\"text-align: justify;\">However, despite the Administrative Code's clear deadlines (maximum 100 days from the communication of the prefect's order if it was not contested, respectively about 130 days from the communication of the prefect's order if it was contested), the Ministry of Internal Affairs does not rush the organization of partial local elections, in violation of Art. 160 par. 11 of the Administrative Code.<\/p>\n<p style=\"text-align: justify;\">FACIAS, as an organization that fights for  citizens' rights, reminds you, Mr. Minister Lucian Bode, that the government's obligations to set the date for the organization of partial local elections and issue a decision in this regard are mandated by law and are not voluntary. As a result, any breach of these criteria is an abuse on the part of the Ministry of Internal Affairs, which has direct responsibility for preparing the draft Government Decision for the organization of elections in municipalities without a mayor.<\/p>\n<p style=\"text-align: justify;\">As a result, we ask you, Minister Lucian Bode:<\/p>\n<ul>\n<li style=\"text-align: justify;\"><strong>Are you aware that you are currently infringing citizens' rights to choose and be elected, as well as the right to a well-managed locality?<\/strong><\/li>\n<li style=\"text-align: justify;\"><strong>When will you deliver the draft Government Decision for the organization of elections in municipalities without a mayor?<\/strong><\/li>\n<\/ul>\n<p style=\"text-align: justify;\"><em>FACIAS is a non-governmental, non-profit, and apolitical organization, a strategic partner of the Council of Europe and the European Commission through the European Association for Local Democracy (ALDA), founded in 2008, and specialized in human rights advocacy.
