{"id":13327,"date":"2022-07-21T14:38:39","date_gmt":"2022-07-21T11:38:39","guid":{"rendered":"https:\/\/facias.ro\/?p=13327"},"modified":"2022-10-03T16:24:33","modified_gmt":"2022-10-03T13:24:33","slug":"cerem-transparenta-in-achizitiile-publice","status":"publish","type":"post","link":"https:\/\/facias.ro\/eng\/cerem-transparenta-in-achizitiile-publice\/","title":{"rendered":"WE DEMAND TRANSPARENCY AND RESPONSIBILITY IN PUBLIC PROCUREMENT"},"content":{"rendered":"<p class=\"wp-block-paragraph\"><strong>The Romanian government saved more than 400 million euros as a result of the actions of the Foundation for the Defense of Citizens Against State Abuses (FACIAS).<\/strong><\/p>\r\n<p class=\"translation-block\">In 2017, FACIAS referred the matter to the Prosecutor's Office of the High Court of Cassation and Justice regarding the possible commission of the offence of abuse of office by the representatives of the Ciolos government, through the adoption of Government Decision no. 906\/2016 on the approval of the circumstances and specific procedures related to the \"Multifunctional Corvette\" strategic armament programme.<\/p>\r\n\r\n\r\n\r\n<p class=\"wp-block-paragraph\"><em>Denun\u021bul FACIAS poate fi vizualizat<\/em><a href=\"https:\/\/facias.ro\/wp-content\/uploads\/2022\/07\/Denunt-M.pdf\"><em> here:\u00a0<\/em><\/a><\/p>\r\n\r\n\r\n\r\n<p class=\"wp-block-paragraph\"><strong>Course of Events:<\/strong><\/p>\r\n\r\n\r\n\r\n<p class=\"wp-block-paragraph\">The procedures for the Ministry of National Defense to conclude a contract with Damen Shipyards Group for the purchase of a program aimed at equipping Romania with four multi-purpose military ships were established and approved by a Government Decision adopted on December 22, 2016. The total cost of the program was estimated to be 1.6 billion euros.<\/p>\r\n\r\n\r\n\r\n<p class=\"wp-block-paragraph translation-block\">FACIAS reported that the Government at the time initiated the procurement by direct award to the Dutch company, in violation of Law no. 98\/2016 - which regulates public procurement and without obtaining the procurement approval from the Romanian Parliament.<\/p>\r\n\r\n\r\n\r\n<p class=\"wp-block-paragraph translation-block\">Ciolos Government representatives adopted this decision without taking into account the law on the award of public contracts in the field of defence and security.<\/p>\r\n\r\n\r\n\r\n<p class=\"wp-block-paragraph\">Following the referral to FACIAS, criminal file no. 133\/P\/2017 was opened with the object of the manner in which the GD was issued, which directly granted Damen Schelde Naval Shibuiding a 1.6 billion euro contract.<\/p>\r\n\r\n\r\n\r\n<p class=\"wp-block-paragraph\">The illegality of H.G. no. 906\/2016 was the premise for the decision to repeal the relevant normative act. After the Government Decision was overturned, two years later, an international auction was held for the construction and delivery of corvettes for the Romanian Army. The French were granted the contract from Naval Group for 1.2 billion euros. Furthermore, this sum included the modernization of two Romanian combat ships, which was valued at approximately 200 million euros.<\/p>\r\n\r\n\r\n\r\n<p class=\"wp-block-paragraph\">On 06.08.2019, the classification was ordered in the criminal file established following FACIAS notification because the reported facts are not provided for by criminal law, and the controversial decisions made by the Government should incur liability through political means.<\/p>\r\n\r\n\r\n\r\n<p class=\"wp-block-paragraph\"><em>Ordonan\u021ba de clasare poate fi vizualizat\u0103<\/em><a href=\"https:\/\/facias.ro\/wp-content\/uploads\/2022\/07\/Ordonanta-133-P-2017-M.pdf\"><em> here:<\/em><\/a><\/p>\r\n\r\n\r\n\r\n<p class=\"wp-block-paragraph\">De\u0219i c\u00e2\u0219tig\u0103torul licita\u021biei a fost desemnat \u00eenc\u0103 din 2019, iar de aproape un an nu mai exist\u0103 contesta\u021bii sau opreli\u0219ti \u00een instan\u021b\u0103 pentru semnarea contractelor, consider\u0103m deosebit de important s\u0103 fie clarificate o serie de aspecte de natur\u0103 s\u0103 \u00eenl\u0103ture suspiciunile privind motivele pentru care se am\u00e2n\u0103 semnarea contractului cu asocierea francez\u0103 Naval Group.<\/p>\r\n\r\n\r\n\r\n<p class=\"wp-block-paragraph\">\u00cen acest sens, FACIAS a solicitat Ministerului Ap\u0103r\u0103rii Na\u021bionale care sunt argumentele concrete pentru care se am\u00e2n\u0103 semnarea contractului cu Naval Group.<\/p>\r\n\r\n\r\n\r\n<p class=\"wp-block-paragraph\">\u00cen r\u0103spunsul primit de la MApN am fost informa\u021bi c\u0103 semnarea contractului-cadrul de furnizare a Corvetelor nu s-a realizat din cauza faptului c\u0103 p\u0103r\u021bile nu au ajuns p\u00e2n\u0103 \u00een prezent la \u00a0un acord asupra con\u021binutului final al contractului.<\/p>\r\n\r\n\r\n\r\n<p class=\"wp-block-paragraph\"><em>R\u0103spunsul MApN poate fi vizualizat<\/em><a href=\"https:\/\/facias.ro\/wp-content\/uploads\/2022\/07\/Raspuns-MApN-corvete-M.pdf\"><em> here:<\/em><\/a><\/p>\r\n\r\n\r\n\r\n<p class=\"wp-block-paragraph translation-block\">FACIAS believes that such an investigation and implicitly holding those responsible accountable are absolutely mandatory steps on the part of the responsible institutions.
