The Foundation for the Defense of Citizens Against State Abuses (FACIAS) reports on a tendency that has increased in recent years: the Romanian state's passivity in retrieving from the ones liable, money paid as compensation and fines in accordance with ECHR and CJEU judgements.<\/p>\n
Following FACIAS's demands, Romanian state institutions notified us that, as compensation for Romania's ECHR convictions, over 99 million euros have been paid since 2004. In reality, the money paid by the Ministry of Finance, the national budget, and, implicitly, the money paid by Romanians is far more. This is because the official figure excludes compensations paid as a result of amicable agreements reached between the Romanian government and those whose rights were violated.<\/p>\n
FACIAS suggests establishing a legal framework modeled after the Law on Magistrates' Liability in the case of compensation paid to the ECHR for prosecuting politicians who do not carry out their obligations with good intentions and do not implement European directives.<\/p>\n\n\n
