We have witnessed many tragedies in the last ten years, caused by a hesitant justice or enslaved to the SRI-DNA binomial, for which the secret protocols were above the legal system and the protection of magistrates' own interests in the \"tactical field\" prevailed over the principle of uncovering the truth.<\/p>\n
Thousands of people were dragged in handcuffs in front of news cameras, and their presumption of innocence was flagrantly violated by prosecutors' statements and information provided to the home press, because, in the end, after long years of lawsuits, those who had the opportunity to be acquitted, were partially or entirely denied the right to compensation. Some of the defendants died before the trial ended, and many others were wrongfully convicted in the lack of clear, direct evidence of guilt or, worse, on the basis of illegitimate or illegally obtained evidence.<\/p>\n
For many years, the criminal justice system in Romania has been characterized by the \"presumption of guilt,\" with the accused being placed in a position to prove their innocence. The presumption of innocence has long been regarded as a \"trend\" inspired by American films, and national authorities have regarded defendants' rights and freedoms as a matter of adornment, of institutional arrangement, with the debate of rights sometimes regarded as a \"Theoretical luxury.\"<\/p>\n
The Romanian justice system appears to have found the right path recently, but there is always the possibility of mistakes caused by magistrates' inexperience or lack of professionalism, as well as inadequate legislation that allows a simplistic approach to the standard of proof required to overturn the accused's presumption of innocence.<\/p>\n
Project\u2019s objectives: <\/em><\/strong><\/p>\n FACIAS aims to conduct an analysis of the most significant cases of judicial abuse in the last ten years, and at the end of the study conducted by our foundation's experts, we will develop a set of appropriate legislative proposals regarding the procedural rules on the standard of evidence, the judicial organization and, respectively, in order to hld magistrates liable for damages caused by judicial errors.<\/p>\n We highlight that FACIAS is a non-governmental, non-profit, and apolitical organization that is a strategic partner of the Council of Europe and the European Commission through the European Association for Local Democracy (ALDA), which was founded in 2008 and specializes in human rights advocacy.
