{"id":11567,"date":"2021-05-13T11:40:00","date_gmt":"2021-05-13T08:40:00","guid":{"rendered":"https:\/\/facias.ro\/?p=11567"},"modified":"2022-08-04T10:53:19","modified_gmt":"2022-08-04T07:53:19","slug":"ghid-practic-continuare-plangerea-prealabila-instrument-de-prevenire-sau-combatere-a-unui-abuz-comis-de-o-institutie-publica","status":"publish","type":"post","link":"https:\/\/facias.ro\/eng\/ghid-practic-continuare-plangerea-prealabila-instrument-de-prevenire-sau-combatere-a-unui-abuz-comis-de-o-institutie-publica\/","title":{"rendered":"Practical Guide (part 2): Prior complaint - a tool to prevent and\/or combat an abuse committed by a public institution"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\"><strong>Cuprins:<\/strong><\/p>\n\n\n\n<ol class=\"wp-block-list\"><li>Pl\u00e2ngerea prealabil\u0103 &#8211;&nbsp; scopul\/ utilitatea<\/li><li>Pl\u00e2ngerea prealabil\u0103<strong> &#8211;<\/strong>c\u00e2nd o folosim \u0219i ce \u00eenseamn\u0103 ea?<\/li><li>Pl\u00e2ngerea prealabil\u0103 pentru acte administrative individuale (afecteaz\u0103 un individ sau o companie)<\/li><li>Pl\u00e2ngerea prealabil\u0103 pentru acte administrative normative (afecteaz\u0103 o colectivitate)<\/li><li>Pl\u00e2ngerea prealabil\u0103 &#8211; scutit\u0103 de taxe, deci nu implic\u0103 vreun cost<\/li><li>Cui transmitem pl\u00e2ngerea noastr\u0103 prealabil\u0103?<\/li><\/ol>\n\n\n\n<p class=\"wp-block-paragraph\">\u00cen articolele anterioare ale Ghidului FACIAS realizat pentru a fi suport al cet\u0103\u021benilor \u00een raport cu institu\u021biile statului, am aflat urm\u0103toarele:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>Cum ne d\u0103m seama, noi, cet\u0103\u021benii, c\u0103 avem de-a face cu un abuz<\/li><li>Criterii minimale pentru a identifica o poten\u021bial\u0103 situa\u021bie abuziv\u0103<\/li><li>Accesul la justi\u021bie, asigurat prin institu\u021biile statului sau prin instan\u021be judec\u0103tore\u0219ti<\/li><li>De unde ne inform\u0103m singuri, pentru a cunoa\u0219te drepturile noastre \u0219i obliga\u021biile institu\u021biilor publice \u00een raport cu noi<\/li><li>Cererea\/Peti\u021bia reprezint\u0103 primul pas &amp; timpii de raspuns impu\u0219i institu\u021biilor, prin lege<\/li><li>Ne putem face dreptate \u0219i f\u0103r\u0103 costuri<\/li><\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Articolul de fa\u021b\u0103 va continua dezvoltarea ghidului FACIAS, aplicat, cu pa\u0219i mici \u00eens\u0103 c\u00e2t se poate de simplificat, prin prezentarea unui alt instrument pe care \u00eel putem folosi cu \u00eencredere atunci c\u00e2nd consider\u0103m c\u0103 suntem leza\u021bi \u00eentr-un drept legitim de c\u0103tre o institu\u021bie a statului: pl\u00e2ngerea prealabil\u0103. Pl\u00e2ngerea prealabil\u0103 ne va ajuta mult \u0219i dac\u0103 decidem apoi s\u0103 mergem \u00een instan\u021b\u0103. Este gratuit\u0103 \u0219\u0103 f\u0103r\u0103 taxe de timbru. Chiar dac\u0103 am depus o peti\u021bie sau o sesizare, vom putea apela \u0219i la acest instrument al Pl\u00e2ngerii prealabile.<\/p>\n\n\n\n<h1 class=\"wp-block-heading\"><strong>1.Pl\u00e2ngerea prealabil\u0103 &#8211;&nbsp; scopul\/ utilitatea<\/strong><\/h1>\n\n\n\n<p class=\"wp-block-paragraph\">\u00cenainte de a se adresa instan\u021bei dac\u0103 ne consider\u0103m v\u0103t\u0103ma\u021bi \u00eentr-un drept \/interes legitim printr-un act administrativ atunci solicit\u0103m autorit\u0103\u021bii publice emitente sau autorit\u0103\u021bii ierarhic modificarea, revocarea, \u00een tot sau \u00een parte, a acestui act.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">De exemplu, orice refuz nejustificat de eliberare a actului solicitat de noi ori lipsa r\u0103spunsului ne d\u0103 dreptul de a urma procedura plangerii prealabile, iar in cazul \u00een care r\u0103spunsul la pl\u00e2ngerea prealabil\u0103 ne lezeaz\u0103 \u00een continuare drepturile noastre legitime, atunci ne vom adresa instan\u021bei de judecat\u0103. \u00cens\u0103, \u00eenc\u0103 nu am ajuns \u00een instan\u021b\u0103 sau la avoca\u021bi.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Men\u021bion\u0103m c\u0103 actul administrativ care ne nemul\u021bume\u0219te se refer\u0103 \u0219i la actele administrative unilaterale \u0219i la refuzul nejustificat de a rezolva o cerere referitoare la un drept sau la un interes legitim ori, dup\u0103 caz, faptul c\u0103 institu\u021bia nu a r\u0103spuns solicit\u0103rii noastre, \u00een termenul legal.<\/p>\n\n\n\n<h1 class=\"wp-block-heading\"><strong>2.Pl\u00e2ngerea prealabil\u0103 &#8211;<\/strong>c\u00e2nd o folosim \u0219i ce \u00eenseamn\u0103 ea?<\/h1>\n\n\n\n<p class=\"wp-block-paragraph\">Am constatat sau am perceput c\u0103 ni s-a f\u0103cut o nedreptate. Am depus peti\u021bie \u0219i sesizare, \u00eens\u0103, \u00een continuare, am r\u0103mas nedrept\u0103\u021bi\u021bi. Urm\u0103torul instrument (face parte tot din procedurile administrative)&nbsp; pe care \u00eel putem folosi,&nbsp; p\u00e2n\u0103 la a ajunge \u00een instan\u021b\u0103, este <strong>Pl\u00e2ngerea prealabil\u0103. <\/strong>Acest instrument este extrem de util \u0219i pentru situa\u021bia \u00een care decidem, ulterior, c\u0103 doar \u00een instan\u021b\u0103 ne-am mai putea rezolva problema.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Pl\u00e2ngerea prealabil\u0103 o folosim pentru a contesta acte administrative individuale sau colective.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">3.Pl\u00e2ngerea prealabil\u0103 pentru acte administrative individuale (afecteaz\u0103 un individ sau o companie)<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Presupunem c\u0103 am solicitat, individual (\u0219i am respectat legea), eliberararea unei adeverin\u021be, \u00eencadrarea \u00een grad \u0219i tip de handicap sau o autoriza\u021bie de construire sau ne-a fost respins dreptul privind concediul, indemniza\u021bia pentru cre\u0219terea copilului, etc. De asemenea, ca persoan\u0103 juridic\u0103 am solicitat o autoriza\u021bie, dar ni s-a respins demersul ori s-a solu\u021bionat cu amendamente, iar noi consider\u0103m c\u0103 nu este corect, iar situa\u021bia tinde s\u0103 se transforme \u00een abuz comis de institu\u021bia statului. Aceste situa\u021bii individuale sunt numite, \u00een diverse texte de specialitate, <strong>acte administrative individuale<\/strong> \u0219i se adreseaz\u0103 persoanelor fizice \u0219i \/sau juridice individuale.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">4.Pl\u00e2ngerea prealabil\u0103 pentru acte administrative normative (afecteaz\u0103 o colectivitate)<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Atunci c\u00e2nd decizia unei institu\u021bii vizeaz\u0103 o comunitate, un grup de persoane direct afectate, oricine put\u00e2nd intra sub inciden\u021ba ei, la un moment dat, cum ar fi o hot\u0103r\u00e2re a consiliului local etc., atunci avem de-a face cu <strong>acte administrative normative<\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Prin aceasta, noi contest\u0103m un act administrativ care ne vizeaz\u0103 \u0219i putem cere anularea sau modificarea lui. Actul administrativ este actul unilateral cu caracter individual sau normativ emis de o autoritate public\u0103, \u00een regim de putere public\u0103, \u00een vederea organiz\u0103rii execut\u0103rii legii sau a execut\u0103rii \u00een concret a legii, care d\u0103 na\u0219tere, modific\u0103 sau stinge raporturi juridice<a href=\"#_ftn1\" id=\"_ftnref1\">[1]<\/a>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>\u00cen concluzie, <\/strong>pl\u00e2ngerea prealabil\u0103 este o procedur\u0103 administrativ\u0103 la care apel\u0103m \u00eenainte de a ajunge s\u0103 d\u0103m institu\u021bia \u00een judecat\u0103, instrument care poate oferi persoanei v\u0103t\u0103mate posibilitatea de a ob\u0163ine rapid rezolvarea ne\u00een\u021belegerii cu o autoritate public\u0103.<\/p>\n\n\n\n<h1 class=\"wp-block-heading\">5.Pl\u00e2ngerea prealabil\u0103 &#8211; scutit\u0103 de taxe, deci nu implic\u0103 vreun cost<\/h1>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Pl\u00e2ngerea prealabil\u0103&nbsp; <\/strong>este o modalitate simpl\u0103, rapid\u0103 \u015fi scutit\u0103 de taxe, prin care noi, persoane v\u0103t\u0103mate \u00eentr-un drept al nostru de o autoritate public\u0103 (institu\u021bie public\u0103) avem posibilitatea de a ob\u0163ine recunoa\u015fterea dreptului pretins sau a interesului nostru legitim direct de la organul emitent<a href=\"#_ftn2\" id=\"_ftnref2\">[2]<\/a>.<\/p>\n\n\n\n<h1 class=\"wp-block-heading\">6.Cui transmitem pl\u00e2ngerea noastr\u0103 prealabil\u0103?<\/h1>\n\n\n\n<p class=\"wp-block-paragraph\">Legea contenciosului administrativ<a href=\"#_ftn3\" id=\"_ftnref3\">[3]<\/a>, prin art. 1, ne spune cui ne adres\u0103m cu aceast\u0103 pl\u00e2ngere prealabil\u0103.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Pl\u00e2ngerea prealabil\u0103 o adres\u0103m institu\u021biei \u00een cauz\u0103 (care a emis actul ce ne nemul\u021bume\u0219te) sau institu\u021biei superioare acesteia. Solicit\u0103m autorit\u0103\u021bii publice care a emis un act\/decizie\/ hot\u0103r\u0103re pe care o consider\u0103m poten\u021bial abuz\/ nedreapt\u0103, sau institu\u021biei ierahic superioare acesteia, reexaminarea actului cu caracter individual (afecteaz\u0103 o pers fizic\u0103\/ juridic\u0103) sau normativ (are impact asupra unei comunit\u0103\u021bi).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u00cen instan\u021b\u0103, mergem dup\u0103 ce am&nbsp; f\u0103cut \u0219i primit raspuns la Pl\u00e2ngerea prealabil\u0103, dac\u0103, \u00een continuare, ne consider\u0103m nedrept\u0103\u021bi\u021bi. Vom avea \u0219i situa\u021bii \u00een care institu\u021bia nu ne r\u0103spunde, iar atunci decidem s\u0103 mergem \u00een instan\u021b\u0103.
